REPAIR OF DAMAGES The Contractor will be held responsible for the condition of the work until the final acceptance by the Owner and will be required to repair any and all damages which may occur before its final acceptance. RESPONSIBILITY OF BIDDER The Contractor shall, prior to the bid, by examination satisfy himself as to the nature and location of the work, the conformation of the ground, the character, quality and quantities of the materials to be encountered, the character of equipment and facilities needed preliminary to, and during the execution of the work, the general and local conditions, and all other matters which can in any way effect the work under this Contract. The Contract will not be awarded to any bidder who cannot give satisfactory assurance of his ability to carry out the Contract if it is awarded to him. INTERPRETATION OF PLANS The plans for the work show conditions as they are supposed to be or believed to exist, but it is not intended or to be inferred that the con- ditions as shown thereon constitute a representation by the Owner or his representatives that such conditions are actually existant, nor shall the Owner or his representatives be liable for any loss maintained by the Contractor as a result of any variance between conditions shown upon the plans and the actual conditions revealed during the progress of the work or otherwise. INTERPRETATION OF SPECIFICATIONS These specifications are intended to be self explanatory but should any misunderstanding or controversy arise as to the interpretation of anything contained herein, the matter shall be referred to the Engineer for decision and the decision of the Engineer shall be final. The Contractor will not be allowed to take advantage of errors or omissions that may occur in these specifications. Remedial instructions will always be given when such errors or omissions are discovered.
