4. Lots 22 through 28 are subject to an easement over the Southwesterly 20 feet <br /> of those lots in favor of the West Side Irrigation District, recorded August 25, 1982, as <br /> Recorder's Document No. 82048739. <br /> 5. Lots 52 through 59 are subject to a dedication of the 6-feet-wide strip along <br /> Von Sosten Road for "road widening purposes." <br /> RESTRICTIONS: This subdivision is subject to Restrictions recorded in the Office of the <br /> San Joaquin County Recorder on July 6, 1984, as Recorder's Document No. 84046633, <br /> which includes, among other provisions, the following: <br /> 1. Prior to any construction, you must obtain approval of your plans by the <br /> Architectural and Planning Board. This Board is appointed by the subdivider. If the <br /> developer, the Architectural and Planning Board, or one of your neighbors sues you for any <br /> violation of the Restrictions by you, you may have to pay their attorney's fees and <br /> expenses. <br /> 2. No change in the established grade or elevation of subdivision lots, and no <br /> change in the established slope or ratio of the cuts and fills, which alters established <br /> drainage patterns shall be permitted without the prior written approval of the Department <br /> of Public Works of the County of San Joaquin, California. For the purpose hereof, <br /> established drainage patterns are defined as the drainage patterns existing at the time the <br /> grading of said property was completed in conformity with the grading and drainage plan <br /> heretofore approved by the County of San Joaquin. <br /> Each of the owners of the lots covenants to permit free access by Declarant, the County <br /> of San Joaquin, and owners of adjacent lots to slopes of drainage-ways located on its <br /> property when such access is required for the maintenance or permanent stabilization of <br /> said slopes, or maintenance of the drainage facilities or for the protection and use of <br /> property other than the lot an which the slope or drainage-way is located. <br /> 3. Each lot owner covenants to keep, maintain, water, plant and re-plant all <br /> areas, slopes, banks, rights-of-way and set-back areas located on-its lot so as to prevent <br /> erosion and any adverse impact an the drainage system and to present an attractive, <br /> clean, sightly and wholesome appearance at all times. The drainage system shall be the <br /> responsibility of each lot owner, but each owner of any lot within said subdivision or the <br /> County of San Joaquin, shall have the right to maintain a cause of action against any lot <br /> owner who violates the drainage requirements imposed by the said County of San Joaquin <br /> and, in connection therewith, to recover all casts, including attorney fees, damages <br /> incidental to a violation thereof and, as part of any court order to compel the lot owner <br /> violating any drainage requirements, at its sole cost, to make any and all corrections <br /> necessary to maintain such compliance. <br /> FOR INFORMATION AS TO YOUR OBLIGATIONS AND RIGHTS, YOU SHOULD READ <br /> THE RESTRICTIONS. THE SUBDIVIDER SHOULD MAKE THEM AVAILABLE TO YOU. <br /> HAZARDS: The following hazards exist within or nearby this development. <br /> 1.
