Huggins that I was going to refer the matter to the District Attorneys Office. <br /> He agreed. <br /> 09/11/00—The file was referred to the District Attorneys Office. <br /> 09/25/00—Meeting with Gerald rector and Don Mann of the San Joaquin County Sheriffs <br /> Office. Mike Huggins, Alan Biederman, and Robert McClellon were present <br /> from the EHD. David Irey was also present for the San Joaquin County <br /> District Attorneys Office. The meeting was held at the site. Gerald Rector and <br /> Don Mann were trying to resolve the issues at the site. I explained that the <br /> property owners are under an Administrative Enforcement Order to clean up <br /> the property, secure the property and investigate the area that was suspected of <br /> having sub-surface disposal. I explained that the EHD referred the issue to the <br /> District Attorneys Office. David Irey explained that he would need to meet <br /> with the owners prior to him making any type of settlement. During the <br /> meeting it was noted that there had been some excavation on the property. <br /> There was a trench that started at the north end of the property and followed <br /> the east property line south to the south property line. The trench then turned <br /> west along the south property line and stopped just short of the west property <br /> line. The trench went through a pile of burned tires and ash. <br /> 03/08/01 —Onsite with District Attorney David Irey, Mike Huggins, Robert McClellon, <br /> Attorney Sherri Kirk of the Kirk Law Firm representing Delta funding. Jack <br /> Meranda of Prudential California Realty was also present. Jack Merenda was <br /> representing a potential buyer. Mr. Merenda was asking questions in regards <br /> to developing to the property for business. The site status was discussed <br /> during the meeting. The trench raised several concerns. One being that that the <br /> trench was excavated with out a plan and by a contractor that may not have <br /> been qualified, or trained to conducted the excavation in a safe manner. <br /> Another concern was that the excavation was excavated through a pile of <br /> burned tires and tire ash. The burned tires and tire ash can be considered <br /> hazardous waste. Other concerns were that the open excavation created a <br /> safety hazard and it exposed burn ash that may contain metals concentrations <br /> above hazardous waste levels. Robert McClellon an employee of the EHD <br /> informed Ms. Kirk that the trench would have to be backfilled and that a plan <br /> would need to be submitted prior to conducting the work. It was suggested <br /> that Delta Funding should hire a consultant to determine the extent of the <br /> buried waste. It stated that any site work would require a plan prior to <br /> conducting the work. The plan would require review and approval by the <br /> EHD. <br /> 03/21/01 —Received a phone call from Jack Merenda of Prudential California Realty. Mr. <br /> Merenda was concerned over a letter that the received in regards to the <br /> property. The letter was from Sherri Kirk Of the Kirk Law Firm. Mr. <br /> Merenda indicated that his client was a potential buyer and that the buyer did <br /> not want any involvement by the EHD after he purchased the property. He <br />
