r <br /> 06/12/00—The EHD received a letter from the Kirk Law Firm. The letter confirmed the <br /> agreements that were made during the meeting of June 08, 2000. The letter <br /> stated that Delta Funding would submit a proposal for securing the property <br /> and determining the southern property boundary. The letter also confirmed <br /> the agreement to investigate the mound that was subject to sub-surface burial. <br /> 07/14/00—The EHD received a letter from Peter Bednarek of Delta Funding indicating <br /> that they were going to have the property surveyed and have the site secured <br /> by trenching access areas. I phoned Peter Bednarek and explained that the <br /> physical barriers should not create a situation where a passerby may become <br /> trapped or become injured. He agreed. <br /> 08/24/00—On or about this date the EHD received a phone call from Lieutenant Gerald <br /> Rector of the San Joaquin County Sheriffs Office. Lt. Rector inquired as to the <br /> site status. He was informed that the site was under a Notice and Order by this <br /> Department and that the owners need to comply. He explained that he would <br /> like to help to get the issues resolved. He offered to be a mediator between the <br /> property owners and this Department. He was informed that if the owners <br /> complied with the Notice and Order that the issued would be resolved. I <br /> referred him to Dee Anne Watkins of County Counsel Office. <br /> 08/28/00—Meeting with Peter Bednarek of Delta funding, Mike Huggins, Steven Shih, <br /> and Robert McClellon of EHD at the site. Peter Bednarek brought a <br /> prospective buyer with him to the meeting. Peter Bednarek was irritable and <br /> was making comments that the EHD was making something out of nothing. <br /> He suggested that the EHD should just drop the issue. The buyer was willing <br /> to do some work to resolve the issues that the EHD had at the site and <br /> explained that he was familiar with environmental cleanups. It was explained <br /> to him what he would have to do in order to remove the Notice and Order and <br /> that this Department was willing to provide assistance and over site to help <br /> resolve the issues. It was suggested that he stop by the Department and review <br /> the file and that it would be made available to him. <br /> 09/08/00—Meeting with Peter Bednarek of Delta Funding,Mike Huggins, Alan <br /> Bedierman and Robert McClellon of the EHD. Peter Bednarek brought <br /> another prospective buyer to the meeting. The site status was discussed with <br /> the prospective buyer and again offered to help by reviewing plans and <br /> providing over-site for the cleanup efforts. The new buyer was provided with <br /> contact information for this Department. <br /> 09/08/00—Robert McClellon an employee of the EHD phoned Dee Anne Watkins of the <br /> County Counsels Office. I explained to her that I did not believe that Delta <br /> Funding was going to comply with the Notice and Order and asked for <br /> direction in regards to further enforcement. Dee Anne indicated that the EHD <br /> could refer the issue to the District Attorney for prosecution. I informed Mike <br />
