CONDITIONS OF APPROVAL <br /> MS-99-29 <br /> Marc& Debra Garcia <br /> Minor Subdivision Application No. MS-99-29 was approved by the San Joaquin County Community <br /> Development Department on March 8, 2000. The effective date of approval is March 18, 2000. This <br /> tentative map approval will expire on March 18, 2003, which is three years from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Jeff Fisher,468-9653) <br /> a. IMPROVEMENT PLAN: Submit an Improvement Plan for the construction of the road. The Plan <br /> must be prepared by a registered civil engineer or licensed architect. This Plan must show drainage, <br /> driveway access details (including gates) and grading (refer to "SITE PLAN CHECK LIST" for <br /> details).A fee is required for the Plan review. (Development Title Section 9-884) <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 200-feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of five(5) acres. (Development Title Section 9-610.2) <br /> c. UNIFORM FIRE CODE: The following Uniform Fire Code and San Joaquin County Ordinance Code <br /> requirements will be applicable and shall be incorporated in the construction plans before submittal <br /> to the Community Development Departmentfor a building permit: <br /> (1) Fire Department access roads shall be in accordance with section 902.2 of the California Fire <br /> Code and the standard adopted by the San Joaquin County Fire Chiefs Association. <br /> (2) The fire access road shall be complete prior to recordation of the Parcel Map. <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision,which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> 3.
