RECEIVED ON 09/02/2022 VIA EMAIL #11: Provide the hazardous materials business plan training record. I have attached a blank template for your reference. Response: HMBP training record is attached. Hazardous Waste 117 , HSC 25185(c)(3)Failed to submit a written response within 30 days of receiving an inspection report. OBSERVATION: This business did not provide a written response to the inspection report dated 4112/2018 within 30 days. The written response was received late on 6/14/2018. REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a written response to the department or the local officer or agency authorized to enforce this chapter pursuant to subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the department or the local officer or agency may reasonably require, which shall include a statement documenting corrective actions taken by the operator or proposing corrective actions which will be taken by the operator, for purposes of compliance with this chapter, or disputing the existence of the violation. The local agency, the San Joaquin County Environmental Health Department, requires response within 30 days. CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department. This is a Class II violation #117: provide a statement how this will be addressed going forward. Response: Inspection reports shall be forwarded to supervisors and consultant immediately. A corrective action statement will be prepared and forwarded to the assigned inspector prior to the date designated by your agency or within 30 days, whichever date is earliest. It will document corrective actions already taken, provide information on proposed corrective actions to include how they will be taken and timelines as appropriate, and/or dispute the existence of a violation if necessary. This statement may also include photos or other documentation of return to compliance. 403 CCR 66262.34(d)(2)Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. OBSERVATION: The following open hazardous waste storage containers were observed on-site- -One black metal 55 gallon drum of fuel contaminated liquid was observed with an open bung in the hazardous waste storage area. REGULATION GUIDANCE: A container holding hazardous waste shall always be closed during transfer and storage. except when it is necessary to add or remove waste. CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed when not adding or removing waste. Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department within 30 days. This is a repeat violation.
