Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />April 04, 2022 <br /> Facility Address: <br /> 19901 S HARROLD AVE, ESCALON <br /> Facility Name: <br /> FRANK BELLINO <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 16 HSC 25507.1 Failed to electronically submit ER plan when not meeting Ag handler exemption requirements. <br />OBSERVATION: This farm business does not meet the requirements for exemption from filing emergency <br />response (ER) procedures in the California Environmental Reporting System (CERS). The inventory was not <br />submitted annually, incomplete signs and no training program. Warning signs were not conspicuous and visible <br />from any direction of probable approach. <br />REGULATION GUIDANCE: To meet this exemption, a farming business shall: <br /> - annually submit the Hazardous Materials Inventory <br /> - mark each building that stores any pesticides, petroleum fuels and oil, or fertilizers with warning signs <br /> - provide training for all employees in safety procedures in the event of a release or threatened release of a <br />hazardous material. <br />CORRECTIVE ACTION(S): Immediately take all steps to meet the requirements for exemption from filing <br />emergency response procedures, or log into the CERS at http://cers.calepa.ca.gov/, and upload emergency <br />response procedures for a release or threatened release of hazardous materials, including, but not limited to, the <br />following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br /> - evacuation plans and procedures, including immediate notice, for the site. <br />Submit proof of correction to the EHD. <br />This is a Class II violation. <br /> 17 HSC 25507.1 Failed to electronically submit training program when not meeting Ag handler exemption <br />requirements. <br />OBSERVATION: This farm business does not meet the requirements for exemption from filing a training plan in the <br />California Environmental Reporting System (CERS). The inventory was not submitted annually, incomplete signs <br />and no training program.
