Conditions Site Approval Application No. SA-01-95 was approved by the San Joaquin County Planning Commission on . The effective date of approval is This approval will expire six months from the effective date of approval unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been issued and remain in force, and (3) all necessary permits from other agencies have been issued and remain in force. Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Jennifer Jolley, 468-3161) a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT'. The Site Plan required as a part of the building permit must be prepared by a registered civil engineer or licensed architect. This Plan must show drainage, driveway access details (including gates), on-site parking, landscaping, signs, existing and proposed utility services, and grading (refer`to the "SITE PLAN CHECK LIST" for details). A fee is required for the Site Plan review. (Development Title Section 9-884) b. APPROVED USE: This approval is for a winery to produce a maximum of 3,500 gallons of wine annually (Use Type: Small Winery). The winery will include the following, as shown on the Site Plan dated December 28, 2001: (1) Construction of a 2,400-square-foot building for wine processing and storage. (2) Conversion of 1,100 square feet on the first floor of a 2,709-square-foot existing recreational room into a tasting room. (3) Addition of a 227-square-foot office with restrooms to the existing recreational room. (4) A maximum of twenty-five(25) marketing events may be conducted on an annual basis. c. MARKETING EVENTS: The following restrictions apply to all marketing events conducted on the site: (1) Marketing events shall end by 10:00 p.m. (Development Title Section 9-1075.5(m[B-2])) (2) The maximum attendants shall be 120 persons. d. COMPLIANCE DATE: Because this development is currently operating without the required permits, plans for the project must be submitted within sixty (60) days of the date of approval. The project must be completed in its entirety within six months from the effective date of approval. e. BUSINESS LICENSE: The applicant shall secure an approved Business License prior to the j initiation of the use. The Business License may be applied for concurrently with the building permit application.
