06 <br /> Harmony Wynelands retained URS/Danes &Moore of Fresno in May, June and July of <br /> 2000 to conduct several noise level studies in conjunction with normal activities and <br /> during events held at the facility. Their findings are discussed in the attached report by <br /> William Stolp, Danes &Moore Senior Manager. <br /> The report concludes that data collected during events, and non-events and daily farming <br /> activities demonstrates that background levels exceeded the 45 dB Hourly Equivalent <br /> Sound Level in the noise ordinance identifying that ambient noise levels exceed the <br /> standard without events. The report further concluded that on event days the 65dB <br /> maximum level was only exceeded between 0.2% and 1.1% of the time at our property <br /> line. Data on a non-event day indicated the 65dB maximum level was exceeded 2.1% of <br /> the sampled time. <br /> Right to Farm <br /> The owners of Harmony Wynelands are completely aware of the Right to Farm ordinance <br /> in San Joaquin County and accept and agreed to its provisions. Guests of Harmony <br /> Wynelands understand that agricultural activities occur at a winery. Events normally <br /> occur on one weekend day and set-up begins around noon on the day of the event. The <br /> events at Harmony Wynelands have not been impacted by the existing surrounding <br /> agricultural activities, including the activities of the facility owners. <br /> 2 <br /> 334202-4 <br />
