One neighbor is concerned about the outdoor events being located so close to his <br /> property. Some events that take place outside during hours of farming activities may be <br /> affected by dust or spraying used on adjacent grapes. The applicant should be aware <br /> that the neighbor has the right to conduct such farming activities pursuant to Division 9, <br /> Chapter 1 (commencing with Section 6-9000) of the ordinance Code of San Joaquin <br /> County (See attached memo regarding "Right to Farm." <br /> Parkin <br /> The applicant has indicated that there will be an average of 150 to 200 people who will <br /> attend each marketing event. Due to the intensity of the marketing events, the parking <br /> areas shall be paved with asphalt concrete or Portland cement concrete. The neighbors <br /> have concerns regarding the parking of cars on adjacent property owner's parcels. <br /> Pursuant to Development Title Section 9-1015.5[d], the parking stalls and directional <br /> arrows shall be delineated with paint and a barricade shall be provided between the <br /> driveway and the north and east property lines. <br /> Marketing Events <br /> Development Title Section 9-1075.1 states: the focus of marketing events should be <br /> wine. A strong nexus must be made between the Marketing Event and the production <br /> and storage of wine. The hierarchy or ranked series of regulations is designed to help <br /> the wine industry thrive by allowing a variety of events and a variety of facility sizes while <br /> simultaneously discouraging or inhibiting on-going uses that would degrade or that <br /> would be incompatible with the ambiance of an agricultural area and the production of <br /> wine. <br /> Marketing events shall be permitted once the applicants are producing wine. In <br /> addition, the number of Marketing Events should be comparable to the size of the Small <br /> Winery which proposes to produce approximately 3,500 gallons or 1,472 cases of wine <br /> annually (2.377 gallons = 1 case of wine). Due to the neighborhood opposition, the <br /> Community Development Department has referred the project to the Planning <br /> Commission tentatively scheduled for November 15, 2001. <br /> The Community Development Department has reviewed the Site Approval application <br /> and responses from other agencies and will be recommending that the Planning <br /> Commission approve the project subject to the following recommended Conditions of <br /> Approval: <br /> Site Approval Application No. SA-01-59 was approved by the Community <br /> Development Department on . The effective date of approval is . This approval will <br /> expire on , which is 18 months from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits <br /> have been issued and remain in force, and (3) all necessary permits from other <br /> agencies have been issued and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements <br /> shall be fulfilled prior to the establishment of the use and the issuance of any <br /> building permits. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other ordinance requirements may apply. <br />
