Minutes , October 18, 1985 Paye 2 <br /> He distributed a letter from Alexander Henson, Attorney represent- <br /> ing adjacent property owners. <br /> Jose L. Alva, representing the Stockton Terminal and Eastern ltail- <br /> road which is the subdivider and principal owner of the Fairchild <br /> Industrial Park, stated that the formation of this County Service <br /> Area was required by the County as a condition of the subdivision <br /> approval. Fie explained that the "storm drainage" function applies <br /> to drainage of roadways only. Individual owners must pond and dis- <br /> pose of their on-site storm drainage. He asked that the Commission <br /> approve the formation of CSA #40 , Fairchild Industrial Park. <br /> Alexander Henson, Attorney for Concerned Citizens of San Joaquin <br /> County, stated that his clients oppose the formation of this County <br /> Service Area for Fairchild Industrial Park and specifically the <br /> Quality Assured Packing tomato cannery. His clients were unsuc- <br /> cessful. in blocking the building permits for the cannery and cur- <br /> rently have a temporary court order prohibiting offensive odors. <br /> lie has also filed suit concerning the adequacy of the County <br /> Gonoral Plan. He opposes approval of this CSA for two reasons . <br /> First, the FTS, is inadequate due to change in circumstances in tile <br /> v ci _ <br /> it (increased r ential development, sewage problems , and <br /> traffic problems) and m u ated rior to a decision. econd- <br /> y, e a eport is incomplete because it does not iscuss all <br /> factors required by G.C. Section 54796. lie submits that the County <br /> General Plan is inadequate for use as a factor considered by The <br /> Commission. For these reasons, he asked that The Commisssion deny <br /> the proposal or continue consideration until you have sufficient <br /> information on which to base your decision. <br /> Kathy Sousa, nearby property owner, spoke in opposition because of <br /> odor, ponding, traffic, noise and lights. <br /> Russell Woodrum, nearby property owner, spoke in opposition. lie <br /> stated that The County ' s report stated that a tomato cannery could <br /> not go there . <br /> .lose Alva spoke in rebuttal. He asked that The Commission focus on <br /> the issues of forming a County Service Area. Services would include <br /> only maintenance and operation of roadway storm drainage, street <br /> lighting , and a water system for fire protection. This is required <br /> by the: County . All facilities have been or will be provided by the <br /> duvcloper. He asked that the Commission approve the proposal as <br /> recommended by staff. <br /> The question of adequacy of the EIR was discussed with Mike McGrew. <br /> The Commission may proceed if it finds that the environmental asses- <br /> sment is adequate for the three purposes and services of the County <br /> Service Area. That is the limit of the Commission ' s jurisdiction in <br /> this matter. <br />
