Thomas and Nancy Blackmun were the <br /> owners of the property. <br /> Based on the previous history and letters received from <br /> adjoining property owners expressing concern about the sub- <br /> division, Planning staff referred the application to the <br /> Planning Commission. <br /> POLICY CONSIDERATIONS: <br /> There are two main issues associated with this Minor Subdivision <br /> application: ( 1 ) qualifications as an owner-operator, and ( 2 ) <br /> the fragmentation of the agricultural parcel . <br /> Qualifications as an Owner-Operator : <br /> Section 9-4104(b) ( 1 ) states that "one parcel of land may be <br /> created for the purpose of financing a residence for not more <br /> than one ( 1 ) owner-operator of an agricultural enterprise. " An <br /> owner-operator is defined as an individual , firm, association, <br /> syndicate, partnership, or corporation having sufficient <br /> proprietary interest in property to exert direct control over <br /> its use and development in its day-to-day operations. On <br /> February 9, 1988 , Mr . Blackmun submitted a letter to the <br /> Planning Division that stated that he cannot be an owner- <br /> operator until such time as he is able to live on the premises. <br /> No substantiation that Mr. Blackmun has "direct control over <br /> day-to-day operations" has been submitted. <br /> Fragmentation of the Agricultural Parcel : <br /> This Minor Subdivision application would create the fifth home- <br /> site parcel out of a 40-acre parcel . Surrounding property <br /> owners have expressed their concern about the breakdown of this <br /> agricultural property. This proposal does not appear to be <br /> consistent with the agricultural principle which discourages <br /> the further fragmentation of agricultural land. <br /> ENVIRONMENTAL CONSIDERATIONS : <br /> An Initial Study was prepared for this project on February 10, <br /> 1988, and no significant effects on the environment were iden- <br /> tified. <br />
