San Joaquin County Variance Renewal <br />V96HQSCD070R2 <br />Page 2 <br />Federal regulatory provisions which allow this variance. Section 279.24 of Title 40, Code of <br />Federal Regulations (40 CFR), allows generators to transport no more than 55 gallons of used oil <br />generated at the generator's site to a used oil collection facility. There are no comparable <br />registration or inspection requirements for transporters of hazardous waste in 40 CFR. <br />Description of activity for which the variance will be issued. This variance will apply only to <br />participants in the agricultural used motor oil collection program. The agricultural used oil has <br />been generated by privately owned agricultural operations from within San Joaquin County. The <br />variance will allow these participants to transport not more than 55 gallons of used oil, not mixed <br />with any other hazardous waste, to one of the several specified, equipped locations listed below. <br />The variance will apply only to generators or their employees transporting used oil in a vehicle <br />owned by the generator. No other hazardous waste will be shipped under this variance. <br />The agricultural used motor oil will be transported in non -leaking, intact, sealed 55 gallon drums, <br />and marked in accordance with DTSC and DOT regulations. Participants will be required to <br />carry a copy of a shipping paper when transporting to the waste oil collection program. <br />Waste oil collection sites authorized to receive used oil under this variance are: <br />Woolsey Oil, Inc., 930 East Victor Road, Lodi, CA 95240 <br />Woolsey Oil, Inc., 166 Frank West Circle, Stockton, CA 95205 <br />Wright's Petroleum, 1512 Weiss Way, Escalon, CA 95320 <br />Van De Pol Enterprises, Inc., 1001 West Charter Way, Stockton CA 95201 <br />Moore Petroleum Co., 5491 West "F" Street, Banta, CA 95304 <br />E.F. Kludt & Sons, 1126 E. Pine Street, Lodi, CA 95240 <br />Olympian MBP, 2191 Navy Drive, Stockton, CA 95206 <br />Stockton Petroleum, 1905 Navy Drive, Stockton, CA 95206 <br />Used oil will be removed from each collection facility by a registered transporter within <br />180 days of the start of collection and taken to an authorized used oil recycling facility. <br />III. SPECIFIC WAIVER. DTSC has determined that the applicant meets the requirements, <br />as outlined in HSC, section 25143, for a waiver from specific regulatory requirements as outlined <br />in Sections II, III, and IV of this variance. The specific findings and determinations made by <br />DTSC are as follows: <br />Authority for granting the variance pursuant to HSC, section 24143. The hazardous waste <br />or the hazardous waste management activity is solely a non -Resource Conservation and <br />Recovery Act (RCRA) hazardous waste or its management is exempt from, or is not otherwise <br />regulated pursuant to RCRA. <br />
