San Joaquin County Variance Renewal <br />V96HQSCD070R2 <br />Page 3 <br />Based on the review of the evidence provided by the applicant, the hazardous waste and the <br />hazardous waste management activity are insignificant or unimportant as a potential hazard to <br />human health and safety and the environment. <br />It has also been determined that the packaging, labeling and placarding of the hazardous waste <br />and actual transportation on the highways are adequately regulated and enforced by the federal <br />Department of Transportation, the California Highway Patrol, and the Department of Motor <br />Vehicles and thus will not pose a substantial hazard to human health and safety or the <br />environment. <br />Specific Waivers Granted. DTSC has determined that participants in the agricultural waste oil <br />collection program are waived from the following statutory requirements for the following <br />specific hazardous waste management activities: <br />HSC, section 25250.8: Participants are granted a variance from manifest requirement; <br />and <br />HSC, section 25163(a): Participants are granted a variance from the transporter <br />registration requirement. <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) EXCLUSION. Based on its <br />review of the same evidence, DTSC finds that it can be seen with certainty that there is no <br />possibility that the granting of this variance may have a significant effect on the environment, <br />within the meaning of section 15061(b) (3) of Title 14, California Code of Regulations (Cal. <br />Code Regs.) <br />IV. TERMS AND CONDITIONS <br />CONDITIONS FOR REVOCATION: This variance is subject to review at the discretion of <br />DTSC and may be revoked at any time. DTSC shall revoke this variance if DTSC finds that the <br />provisions outlined in HSC, section 251432(d) for variance revocation have been met or on the <br />basic of changes in DTSC policy. <br />SPECIFIC TERMS AND CONDITIONS OF THIS VARIANCE: The applicant and <br />participants shall be subject to the following conditions: <br />1. The applicant shall immediately notify DTSC of any noncompliance with the terms of <br />this variance; <br />
