planning Commission <br /> August 2 , 1984 <br /> Page 5 <br /> Public Works said he believed the condition could be modified. <br /> Sandra Affonso said that Public Works would not be obligated to <br /> approve a modified condition. Al Blevins said that Public Works ' <br /> position is that terminal drainage should be the condition, that <br /> a modified condition could possibly be worked out , but that <br /> should not stop the applicant from dealing with the irrigation I' <br /> district in getting their approval to take the water . He <br /> suggested the item be continued if they wished to attempt a modi- <br /> fication of the condition. <br /> Mr . Olmstead referred to page 4 , Item J, of Public Works' con- <br /> dition of full street width improvements. He said his engineer <br /> has made a mistake .in requesting a 60 ' right-of-way and a 40 ' <br /> paved section on Etcheverry Drive. Mr. Olmstead pointed out to <br /> him that since all of the other streets that come into that area <br /> are 50 ' right-of-way and 32 ' paved sections, they should request <br /> a clarification of Condition J to state a 50 ' right-of-way and a <br /> 32 ' paved section. <br /> OPPONENTS <br /> George Brenner, Director of Community Development for the City <br /> of Tracy, was present to express his concerns. He wondered how a <br /> Negative Declaration could be prepared when he has heard nothing <br /> of any percolation tests being conducted for problems with water <br /> sources , soil tests, or how storm drainage could be handled. He <br /> also said there needs to be more dedication along MacArthur Drive <br /> and that there should a minor arterial for the area. He said <br /> there should be a 42 ' dedication from the center line and that <br /> the 60 ' right-of-way is not adequate . <br /> Al Blevins said Public Works has no problem with the 60 ' <br /> right-of-way. <br /> PUBLIC HEARING CLOSED <br /> MOTION: Moved and seconded (Jungeblut-Berglund) and carried by a <br /> unanimous roll call vote to adopt the Negative Declaration and <br /> approve the project based on the findings and subject to the con- <br /> ditions in the staff report , with the following changes : <br /> Condition No. 2 , Banta Carbona Irrigation District , is changed to <br /> read, "The district ' s open irrigation lateral adjacent to the <br /> subdivision is to be fenced at the developer ' s expense and is to <br /> be approved by Banta Carbona Irrigation District and the <br /> Department of Public Works. " <br /> Condition 3 . ( j ) of Public Works ' conditions is changed to read, <br /> "Full street width improvements along Etcheverry Drive and Court , <br />
