UbE PERMIT APPLICATION N2 U-73-9 <br /> Approved-B/S-2-15-73 <br /> USE PERMIT CONDITIONS: <br /> 1. The permitted use shall not at any time develop into a nuisance, as herein defined. If, in the opinion of the <br /> Board of Adjustment, Planning Commission or Board of Supervisors, any County Ordinance or State Law or <br /> regulations or conditions attached hereto are being violated in connection with the operation of this use, that <br /> they retain the power to revoke or modify this permit. For the purposes of this use permit, a nuisance is defined <br /> as follows: <br /> "Nuisance is defined as anything resulting from unreasonable or unlawful practices or from. <br /> neglect which is, or tends to be injurious to health, saftey or public welfare, or is unsightly <br /> or offensive to the senses so as to interfere with the comfortable enjoyment of life or property <br /> in the neighborhood area, as such neighborhood area is defined by the Planning Commission <br /> or Board of Adjustment." <br /> 2. The attached Plot Plan is hereby made a permanent part of this approved use permit and shall be identified as <br /> "EXHIBIT A," and all construction, reconstruction, moving, remodeling or other structural alteration shall be <br /> made in conformity therewith. Any variation from said Plot Plan shall be first approved by the Planning Depart- <br /> ment, Commission or Board of Adjustment. <br /> 3. This use permit is granted under the condition that said permit not be transferred within a 90-day period after <br /> the date-or approval. <br /> 4. The site shall be prepared and operated in accordance with recommendations <br /> presented in the report prepared by EMCON ASSOCIATES entitled "Geotechnical <br /> Investigation and Waste Management Studies" , Proposed 157 - Acre Class II-I <br /> Disposal site, Stockton, California, for Forward, Inc. , dated July 7, 1972, <br /> including proposed berms for flood protection; <br /> 5. The building shall be flood proofed to protect the building from Inter- <br /> mediate Regional Flood, now estimated to be shall flooding less than 2 feet <br /> deep on the average; <br /> 6. A Development Plan indicating the on-site roadways and parking areas, <br /> location of all buildings and structures involved in monitoring the <br /> operation, depth and heigh of landfill, protective berms, fences and <br /> landscaping proposed to reduce noise, approved by the Planning Director; <br /> 7. Public and vehicular traffic shall be routed in the recovery station and <br /> not directly to the disposal site;. <br /> 8. Surface run off of storm waters from the disposal site shall be drained <br /> to South Little John Creek; <br /> 9. Berms shall be maintained at heights that will prevent refuse from being <br /> carried downstream during high water; <br /> 10. Subject to all requirements of the Local Health District and subject to <br /> application and permit conditions as per Ordinance 877 and Rules and <br /> Regulations for operation of a Sanitary Landfill; <br /> 11. Conformance to all criteria, discharge specifications, monitoring and <br /> reporting provisions, and requirements for discontinuance of the <br /> California Regional Water Quality Control Board, Central Valley Region; <br /> 12. The site shall not be open to the general public, unless decided otherwise <br /> by the Board of Supervisors. Any fees charged to the public shall be <br /> subject to approval by the Board of Supervisors; <br /> 13. Applicant shall post a bond in an amount determined by the Public Works <br /> DepartmentiD be sufficient to restore the site in the event the applicant <br /> terminates the project and fails to comply with all conditions of approval, <br /> subject to approval by the Board of Supervisors; <br /> 14. A re-use plan of the site to be approved by the Board of Supervisors prior <br /> to Feb. 15, 1974. Such re-use plan may be revised, subject to approval of <br /> the Board of Supervisors, to serve changing needs; <br /> 15.
