I <br />1 <br />WHEREAS the San Joaquin County Environmental Health Division <br />2 <br />has authority to act as the enforcement agency for this illegal <br />3 <br />to Public Resources Code, <br />solid waste disposal site pursuant <br />4 <br />section 45000, 45005, and 45011; and <br />5 <br />WHEREAS the owner has allowed accumulation of solid waste on <br />6 <br />said property without a solid waste facilities permit in violation <br />7 <br />of Title 27 California Code of Regulations, section 21563(b); an <br />8 <br />WHEREAS this disposal site is a public nuisance in violation <br />9- <br />of Title 27 California Code of Regulations, sections 20760 <br />10 ^ <br />Nuisance Control and 20830 - Litter Control - San Joaquin County <br />11 <br />Ordinance Code No. 2887 Sections 5-2200 - General Requirements, - <br />12 <br />2400 - Accumulation of Waste Prohibited, 5-2401 - Disposal on <br />13 <br />Premises, 5-2402 - Containers Required, 5-2600 - Disposal Area <br />14 <br />Permit Required; and <br />15 <br />WHEREAS this disposal site is a threat to human health an <br />16 <br />safety and the environment from fire potential, vectors, an <br />17 <br />physical hazards from exposed solid/hazardous wastes in violation <br />18- <br />of Title 27 California Code of Regulations, section 20680(d <br />19Cover, section 20810 - <br />Vector Control, and section 20870 - <br />20 <br />Hazardous Wastes; and <br />21 <br />WHEREAS the San Joaquin County Environmental Health Division <br />22 has the authority pursuant to Public Resources Code, sections <br />23 <br />45000, 45005 and 45011 to order the property owner to cease an <br />24 <br />desist any improper action, and to take corrective action to <br />25 <br />correct the aforementioned violations following a time schedule <br />26 <br />established by San Joaquin County Environmental Health Division <br />, <br />27 <br />•.for the site to be brought into compliance; i <br />2. <br />
