1 <br />to administratively impose a civil penalty not to exceed five <br />2 <br />thousand dollars ($5,000) for each day on which a violation <br />3 <br />occurs, and not to exceed fifteen thousand dollars ($15,000) in <br />4 <br />any one calendar year if compliance is not achievedwithinthe <br />5 <br />time schedule in this Notice and Order. <br />6 <br />2. Pursuant to Public Resources Code, section 45014, upon <br />7 <br />failure of the owner to comply with this Notice and Order the San <br />8 <br />Joaquin County Environmental Health .Division may petition the <br />9 <br />superior court for an injunction to restrain the owner from <br />10 <br />continuing to violate the order and to impose, assess, and recover <br />11 <br />civil penalties. <br />12 <br />3. Pursuant to Public Resources Code, section 45023, any <br />13 <br />person who owns a solid waste disposal site and operates that site <br />�4 <br />without a solid waste facility permit or intentionally or <br />15 <br />negligently violates standards adapted by the California Waste <br />16 <br />Management Board (CIWMB) is subject to a civil penalty not to <br />17 <br />exceed ten thousand dollars ($10,000) for each day the violation <br />18 <br />occurs. <br />19 4 pursuant to Public Resources Code, section 48020 et <br />20 <br />seq, the CZWMB may remediate said property if the owner fails to <br />21 <br />correct the aforementioned violations by the specified dates an <br />22 <br />may seek repayment from the owner for the amount expended for <br />23 <br />remediation, cost of administration of the remediation, an <br />24 <br />interest which would have been earned on the funds expended. <br />25 <br />The San Joaquin County Environmental Health Division <br />26 , <br />shall not be liable for injuries or damages to persons or property <br />27 I 1resulting from acts or omissions by the owner or his/her agents in <br />M <br />
