AFFIDAVIT <br /> �= 1 <br /> "EXHIBIT B" <br /> 2 <br /> Your affiant is currently employed by the San Joaquin <br /> 3 <br /> County District Attorney' s office as an investigator . and is <br /> 4 <br /> currently assigned to the Environmental Prosecutions Unit. <br /> 5 <br /> Your affiant has been a peace officer for over 11 years . Your <br /> 6 <br /> affiant has attended a 40 hour course in hazardous waste <br /> 7 <br /> investigation sponsored by the California Hazardous Materials <br /> 8 <br /> Investigators Association. Your affiant has participated in <br /> 9 <br /> no less than 6 on site inspections of hazardous waste <br /> 10 <br /> generator, transport or storage facilities . Your affiant has <br /> 11 <br /> investigated no less than 30 cases of alleged illegal <br /> 12 <br /> transportation and/or disposal of hazardous materials . Your <br /> 13 <br /> affiant has participated in the execution of over 20. search <br /> 14 <br /> warrants . Your affiant is aware that illegal storage, <br /> 15 <br /> treatment or disposal of hazardous waste are felonies pursuant <br /> 16 <br /> to Health and Safety Code section 25189 . 5 . Disposal of waste <br /> 17 <br /> 18 oil is covered by Health and Safety Code section 25250, et. <br /> seq. Aerosol cans are covered in Health and Safety Code <br /> 19 <br /> 20 section 66261 . 2 . <br /> • On July 13, 1992 , your affiant conducted an inspection of <br /> 21 <br /> 22 the defendants property along with representatives of the San <br /> 23 Joaquin County Public Health Department and the Air Pollution <br /> 24 Control District. During the inspection, I observed a 55 <br /> 25 gallon drum that contained approxiametly 10 gallons of liquid. <br /> 26 Mr. Herman Meyer, attorney for the defendant and the <br /> defendant, Bill Lane, informed your affiant that the material <br /> 27 <br /> was waste oil from a tractor that was on Mr. Lanes ' property. <br /> 28 <br /> 1 <br />
