USE OF RESTRAINTS <br /> The use of restraints shall not be used as punishment. Any deputy who uses such restraints(straight- <br /> jacket, gag, thumbscrews,etc.)shall be guilty of a misdemeanor(PC 673). Restraints may be used on <br /> violent prisoners. <br /> HANDCUFFS. BELLYCHAINS AND LEG SHACKLES <br /> Prisoners that are brought to the Manteca Court shall be handcuffed and leg shackled. These items shall <br /> remain on while the prisoners are at the court and while being transported to and from. Belly chains <br /> may be used on prisoners if required and shall be on all Level 8 prisoners. <br /> Any handcuffs or belly chains may be removed so the prisoner may attend to personal hygiene. Upon <br /> completion, the handcuffs shall be replaced. <br /> Handcuffs may be removed while the prisoner is in the courtroom during a preliminary hearing if so <br /> requested by the prisoner's attorney. This practice will be predicated on several factors. Factors to be <br /> considered will be the prisoner's demeanor,the type of crime, and the classification of the prisoner by the <br /> county jail classification unit. If a deputy is unsure,he or she should contact a supervisor. <br /> BRUTALITY TOWARD PRISONERS <br /> Brutality.toward prisoners will not be tolerated. This type of treatment is outlined in California Penal <br /> Code Sections 147, 149,and 673. Deputies found guilty can be fined, given one year in the county jail, or <br /> both. Also,the deputies,if found guilty,can have their employment terminated. <br /> The use of handcuffs and leg shackles will not be used on prisoners if they have a physical handicap that <br /> such items would further injure or irritate. Deputies are to use common sense in these cases and if any <br /> doubt exists contact a supervisor. <br /> CUSTODY HEALTH STATUS <br /> PRISONER MEDICATION <br /> No medication will be allowed to be taken into the court holding facility. The only exception will be <br /> medication ordered by a physician for the immediate well-being of the prisoner. In this case, the <br /> prescribed medication will be given to the prisoner according to the prescription. <br /> 5 <br />
