Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />September 01,2022 <br />Facility Address: <br />1323 W CHARTER WAY, STOCKTON <br />Facility Name: <br />ASSOCIATED TRACTOR SVC INC <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR -Notice to Comply) <br />RemarksItem # <br />9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business plan information was <br />not submitted until 1/29/21 for 2021. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year . <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This was corrected on site. <br />This is a repeat violation, Class II. <br />10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br />OBSERVATION: During the inspection, at least one 55 gallon drum of acetone found inside building 2 at the <br />northwest corner of the building, three 55 gallon drums of oily soil (greater than 500 pounds, actual weight was not <br />available) found at the steam cleaning pad, and two 55 gallon drums of oily absorbent (greater than 500 pounds, <br />actual weight was not available) found at the waste oil storage area have not been reported to CERS. According to <br />drum labels and Lawrence Borelli the material has been on site greater than 30 days. The business has not <br />updated and submitted the information within 30 days. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br /> a) A 100 percent or more increase in the quantity of a previously disclosed material . <br /> b) Any handling of a previously undisclosed hazardous materials <br /> c) A change of business or facility address <br /> d) Change business ownership <br /> e) Change of business name <br /> f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the <br />business plan. <br /> (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507, change the operational knowledge of the facility, or impede <br />implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a repeat violation, Class II. <br />FA0009152 PR0519423 SC001 09/01/2022 <br />EHD 19-01 Rev. 12/06/2021 Hazardous Materials Program OIRPage 3 of 4 <br />1868 E.
