RCRA Permit - Forw9ad Landfill May 1991 <br /> EPA I.D. CAD 990 794 133 Modification 0 <br /> (b) Post-closure use of the property on or in which <br /> hazardous waste remains after closure shall never <br /> be allowed to disturb the integrity of the final <br /> cover, liner(s) , or any other components of any <br /> containment system, or the function of the <br /> facility's monitoring system. New future uses must <br /> be reviewed by the Agency and must not adversely <br /> impact the integrity or function of the closure <br /> system. <br /> (c) As specified in 40 CFR 264.117 (a) (1) , the owner or <br /> operator shall provide care in accordance with the <br /> "Post-Closure Monitoring Plan" for at least 30 <br /> years after the date of completing closure. <br /> However, the owner or operator may petition the <br /> Agency to allow some or all of the requirements <br /> for post-closure care to be discontinued or al- <br /> tered before the end of the 30-year period. As <br /> specified in 40 CFR 264.120, the petition shall <br /> include evidence demonstrating the secure nature <br /> of the facility that makes continuing the <br /> specified post-closure requirements unnecessary <br /> (e.g. , no detected leaks and none likely to occur, <br /> characteristics of the waste, application of ad- <br /> vanced technology, or alternative disposal, treat- <br /> ment, or reuse techniques) . Alternately, the <br /> Agency may require the owner or operator to con- <br /> tinue one or more of the post-closure care and <br /> maintenance requirements contained in the <br /> facility's post-closure plan for a specified <br /> period of time. The Agency may do this if they <br /> find there has been noncompliance with any ap- <br /> plicable standards or requirements, or that such <br /> continuation is necessary to protect human health <br /> or the environment. At the end of the specified <br /> period of time, the Agency will determine whether <br /> to continue or terminate post-closure care and <br /> maintenance at the facility. The owner or <br /> operator may petition the Agency for an extension <br /> or reduction of the post-closure care period based <br /> on cause. These petitions will be considered by <br /> the Agency at the time the post-closure plan is <br /> submitted and at five-year intervals after the <br /> completion of closure. <br /> (d) Facility security <br /> In addition to the facility security measures <br /> described in the "Post Closure Plan" the facility <br /> will post signs at all entrances in both English <br /> and Spanish with the legend "Danger-Unauthorized <br /> Personnel Keep Out.
