Post-closure plan; amendment of plan <br /> (a) The owner or operator shall follow the "Post- <br /> Closure Plan." This plan shall identify the ac- <br /> tivities which will be carried on after final <br /> closure and the frequency of those activities. It <br /> shall include but not be limited to monitoring and <br /> remedial measures for site settlement. <br /> (b) As specified in 40 CFR 264.118 (d) the owner or <br /> operator may request approval from the Agency to <br /> amend the post-closure plan at anytime. Any <br /> amendments to the plans listed above must be sub- <br /> mitted to the Agency for review and approval 30 <br /> days prior to implementing any changes. Modifica- <br /> tions shall be made according to Permit Condition <br /> I.2 of this permit. <br /> 3. - - Notice to local- land authority <br /> As specified in 40 CFR 264 Subpart G, within 90 days <br /> after closure is completed, the owner or operator shall <br /> submit to the local land authority and to the Agency a <br /> survey plat indicating the location and dimensions of <br /> disposal areas with respect to permanently surveyed <br /> benchmarks. This plat shall be prepared and certified <br /> by a professional land surveyor. The plat filed with <br /> the local land authority shall contain a note, <br /> prominently displayed, which states the owner's or <br /> operator's obligation to restrict disturbance of the <br /> site as specified in Permit Condition II. 1. (b) . In ad- <br /> dition, the owner or operator shall submit to the <br /> Director, Hazardous Waste Management Division, United <br /> States Environmental Protection Agency, California <br /> Department of Health Services, and to the local land <br /> authority a record of the type, location, and quantity <br /> of hazardous wastes disposed of within the facility. <br /> 4. Notice in deed to property <br /> The owner of the property on which the facility is lo- <br /> cated shall record, in accordance with California and <br /> federal law, a notation on the deed to the facility <br /> property (or on some other instrument which is nor- <br /> mally examined during title search) that will in per- <br /> petuity notify any potential purchaser of the property <br /> that: (1) the land has been used to manage hazardous <br /> waste, and (2) its use is restricted under Item 1(b) or <br /> 1(c) , unless reviewed by the Agency. <br /> 13 <br />
