AVAILABILITY RETENTION AND DISPOSITION OF RECORDS (a) All records including plans, required in this document shall be furnished upon request, and made available at all reasonable times for inspection, by an officer, employee, or representative of the Agency who is duly designated by the Director. (b) The retention period for all records required in this document is extended automatically during the course of any unresolved enforcement action regarding the facility or as requested by the Agency. 3 . ANNUAL REPORT The owner or operator shall prepare and submit a single copy of an annual report to the Agency by the anniver- sary of the effective date of this permit each year beginning 1990. The annual report shall cover facility activities during the previous calendar year and shall include the following information: (a) The EPA identification number, name, and address of the facility; (b) The calendar year covered by the report; (c) A summary of any releases; (d) A summary of site maintenance activities; (e) Monitoring data; (f) The amount of subsidence that has occurred to date; and (g) The certification signed by the owner or operator of the facility or his authorized representative. VIII. CORRECTIVE ACTION FOR CONTINUING RELEASES 1. Section 3004 (u) of RCRA (Section 206 of the Hazardous and Solid Waste Amendments of 1984) and regulations promulgated as 40 C.F.R. 264. 101 and 270.32 (b) (2) , re- quire the Permittee to institute corrective action as necessay to protect human health and the environment 35
