CA 95827-2106 <br />i9MOSS.7700 <br />October 5. 1992 <br />Mr. Gregory Basso <br />Vice President <br />Forward Incorporated <br />Post Office Box 6336 <br />Stockton, California 95206 <br />REPORT OF VIOLATION <br />Dear Mr. Basso: <br />ME WILKS, Gom"Nof <br />On September 3, 1992, the Depart=ent of Toxic Substances <br />Control (Depart=ent) conducted an inspection of Forward <br />Incorporated's (Forward) facility in Manteca, California. <br />As a result of this inspection, violations of hazardous <br />waste statutes and regulations were identified. <br />Schedule of Violations <br />22, California Code of Regulations (Cal. Code of <br />Regs.), section 66265.71 (a)(6): <br />M <br />The owner/operator or the facility's agent shall retain at <br />the facility a copy of each =anifest for at least three <br />years from the date of delivery. <br />On or about September 3, 1992, Forward failed to retain <br />copies of each manifest for at least three years. Forward <br />only had copies of manifests for the current year. Forward <br />failed to have copies for manifests from September 3, 1989 <br />to December 31, 1991 at the facility. <br />2. Title 22, Cal. Code of Regs., section 66262.34 (f): <br />Generators who accumulate hazardous wastes on site without a <br />permit shall comply with labelling and marking requirements. <br />on or about, September 3, 1992, Forward failed to comply <br />with labelling and marking requirements by storing waste oil <br />in a 500 gallon storage tank without marking the date of <br />accumulation, the words "Hazardous Waste," the physical <br />state of the waste, a statement identifying the hazardous <br />properties of the waste and Forward's name and address. <br />IN <br />
