IN ADDITION, THE BODY ART PRACTITIONERS FOR THIS MOBILE BODY ART FACILITY <br />ARE NOT REGISTERED AS BODY ART PRACTITIONERS WITHIN ALAMEDA COUNTY. <br />CORRECTIVE ACTION: IMMEDIATELY CEASE AND DESIST OFFERING AND CONDUCTING BODY ART <br />(PIERCING) SERVICES WITHOUT A VALID MOBILE BODY ART FACILITY PERMIT AND VALID BODY ART <br />PRACTITIONER REGISTRATION(S) WITHIN ALAMEDA COUNTY TO AVOID FURTHER ENFORCEMENT <br />ACTION. <br />The Alameda County Department of Environmental Health, Solid/Medical Waste Management and Body <br />Art Programs, the Local Enforcement Agency (LEA), received a complaint on September 13, 2022, <br />alleging that unpermitted body art activities (body piercing) were being provided by the unpermitted <br />practitioners at the unpermitted mobile body art facility (It's Just a Poke) at a fundraising event held on <br />September 4, 2022, at 9819 Pearmain Street Oakland, CA 94603. Mobile Body Art facility operators and <br />Body Art practitioners engaged in the business of body piercing in California must register and obtain a <br />permit to operate from the local environmental health department. <br />Section 119301. General Provisions <br />(d) "Body art facility" means the specified building, section of a building, or vehicle in which a <br />practitioner performs, or demonstrates for the purpose of instruction, body art, including <br />reception areas, the procedure area, and the decontamination and sterilization area. <br />Conducting body art activities without a valid body art facility permit and body art practitioner permit is <br />in violation of the following sections of the Safe Body Art Act, California Health and Safety Code, Division <br />104, Part 15, Chapter 7: <br />Section 119306. Practitioner Registration Requirements <br />A person shall not perform body art at any location other than a permitted permanent or <br />temporary body art facility. <br />A person shall not perform body art if he or she is not registered with the local enforcement <br />agency.
