It's Just a Poke — CEASE AND DESIST NOTICE <br />October 27, 2022 <br />Page 2 of 2 <br />Section 119312. Facility Permit Requirements <br />(a) A body art facility shall not conduct business without a valid health permit. <br />Section 119323. Penalties <br />Performing body art without being registered, performing body art at an unpermitted location, <br />operating a body art facility without a health permit, or operating a temporary body art event <br />without a permit shall be a misdemeanor. The local enforcement agency may also assess an <br />administrative penalty in an amount not less than twenty-five dollars ($25) and not more than <br />one thousand dollars ($1,000) for violation of any provision of this chapter. <br />A mobile body art facility permit application and a body art practitioner registration application were <br />received by the Department on April 13, 2020 for It's Just a Poke. The LEA has been waiting for the <br />mobile body art facility applicant to submit the mobile facility certification from the California <br />Department of Housing and Community Development (HCD). The application and registration <br />documents have been reviewed pending the certificate from HCD, and this application has not been <br />approved nor have permits been issued at this time. Body art activities are not allowed to be conducted <br />from this mobile body art facility within Alameda County until the application and review process has <br />been completed and the body art facility permit is approved. In addition, the facility and practitioner(s) <br />must obtain all other necessary business license(s) and other permit(s) required for legal operation of <br />this mobile facility. <br />Please contact Alvin Dang at (510) 639-1330 to confirm receipt of this NOTICE by 5:00PM on <br />November 3, 2022. You may also send an email to alvin.dang@acgov.org confirming receipt of this <br />NOTICE by the same date and time.
