Hazelton Avenue <br />Stockton, California 95205 <br />via email at: cpresto@sjgov.org <br />Re: Response to Notice to Abate <br />Stockton Terminal & Eastern Railroad <br />Dear Ms. Presto: <br />This responds to the abatement notice sent to Stockton Terminal & Eastern Railroad ("STE") <br />dated March 17, 2022 requesting that we evaluate and address potential asbestos in two locations <br />on STE property in Stockton, California. STE operates a railroad in Stockton but does not use or <br />dispose of asbestos. Prior to receipt of the abatement notice, we were unaware that asbestos was <br />present on our property. <br />In response to the notice, STE quickly hired SET — Stockton Environmental Inc. ("SET") to <br />evaluate the two locations (the "Locations") you identified and have made a hazardous waste <br />determination. SEI's report is attached. Further, STE has engaged both a Certified Asbestos <br />Consultant, National Analytical Laboratories, Inc. ("NAL") and a Registered Asbestos <br />Abatement Contractor, A-1 Remediation Service ("A-1") to expedite abatement of the asbestos <br />containing material ("ACM"), including removal of that visible on the surface in the Locations, a <br />process we hope to begin as soon as in the next few weeks. With respect to subsurface ACM, the <br />recommended mitigation is encapsulation through asphalt paving or bringing in sufficient clean <br />fill covering. A remedial action work plan is being prepared by NAL for submittal to you and <br />San Joaquin County Environmental Health Department ("SJEHD"). NAL is also assisting in <br />developing appropriate safety protocols for work performed in STE's railyard (including air <br />monitoring). All onsite ACM abatement work will be closely coordinated between SJEHD, STE, <br />NAL and A-1. <br />The abatement notice also references two addresses: 1217 Stoakes Avenue and 1300 N Gertrude <br />Avenue. STE has evaluated the two locations you identified, but has not verified that the <br />addresses in the abatement notice accurately reflect the two locations. <br />1282 N.
