IL •MI.\ ['Jr:
a\;y
The abatement notice also includes several violations, which STE reserves its rights to contest.
STE may also request from you additional information to support the violations cited. We are
also concerned that the notice cites to California Health and Safety Code Section 25189.5, which
appears to result in criminal penalties for the knowing disposal of hazardous waste. This is not
applicable to the facts in our case, as we were only made aware of the potential for asbestos
through the abatement notice.
STE intends to work cooperatively with you to abate, or otherwise contain, the asbestos on our
property. We will also submit copies of hazardous waste manifests and disposal records when
those are available, as well as our plans to contain the asbestos containing materials which are
underground. If there are other corrective measures necessary, please let us know. If you have
additional questions, please contact me at (303) 398-4549 or lcrose@omnitrax.com. We look
forward to working with you.
Sincerely,
Kenneth Rose
Dir. of Engineering & Environmental Services
for Stockton Terminal & Eastern Railroad
Attachment
cc: Ricky Hegeduis, at rhegeduis@omnitrax.com
Andrew Evans, at aevans@omnitrax.com
