Copied Ricky PRESTO
Hegeduis <rhegeduis@omnitrax.com>, Andrew Evans <aevans@omnitrax.com>,
ron@rbenvironmentalinc.com; Manzo, Elena K. [EHD] <emanzo@sjgov.org>;
Stacey Posey <sposey@omnitrax.com>, Kelli Dunn <kdunn@omnitrax.com>,
Scott Remington <sremington@omnitrax.com> .
Received an email back from Ken Rose that they are working with Registered
Asbestos Abatement Contractors to get a scope of work and schedule set for the
asbestos abatement in the railyard. They are planning on submitting that with the
sample report at the same time, possible sometime next week.
07/11/2022 Discussion with program coordinators on asbestos results received. PRESTO
07/11/2022 Submitted complaint to CalOHSA regarding asbestos on railtracks. Emailed
AirQuality contact regarding sample results showing asbestos. Emailed Regional
State Water Board checking if they need to be notified on the asbestos.
07/12/2022 Reviewed asbestos samples and cover letter. Emailed Ken Rose back that they
only violation was to make a hazardous waste determination based on the alleged
complaint of asbestos which has been address by the sampling and plan to abate.
Asked him in his email if he has been in contact with the Air Pollution Control
Board because he mentioned being being coordinated with Air Quality in his email
but it didn't mention that in the cover letter of the samples. Email from Ken that
they are currently not working with Air Pollution Control Board. Emailed him back
that he may want to contact them just in case they need any permits or
notifications.
Emailed Air Pollution Control Board inspector snippet of the samples. Per Air
Pollution, since the materials were discovered in situ, the regulation they enforce
doesn't apply and their permits/notifications are for demolitions or renovations and
the issue would be worker protection but that would be under CalOSHA.
PRESTO
PRESTO
07/26/2022 Reviewed Fluxx information from DTSC. Emailed DTSC to verify what we need to PRESTO
send on application for this asbestos incident. Email program coordinator to verify
if we should submit application for lead agency request. Received email from
DTSC that air quality monitors asbestos. Emailed program coordinator update
from DTSC.
08/17/2022 Read work plan submitted by asbestos remediator. Searched to verify contractor PRESTO
was a certified asbestos contractor. Found them on the Cal/OSHA asbestos
registrants database - Al Remediation Service.
08/17/2022 Discussion with program coordinator on how to handle abatement since they have PRESTO
completed clean up and it is not at levels for Air Pollution to regulate and DTSC
has referred us back to Air Pollution
08/23/2022 Called County Code Enforcement to verify if they need to be aware of this
asbestos complaint.
