We have reviewed <br /> the letter of September 13 , 1988 , to you from Mr. Don Dier, <br /> Jr. and Martha Vazquez of the California Waste Management <br /> Board (the "CWMB letter") . <br /> There is evidently some confusion, and we would like <br /> to clarify several matters. <br /> In December, 1987 , you were provided four volumes of <br /> information prepared by Eljumaily & Butler Associates (the <br /> "EBA report") . <br /> The EBA report is clearly titled "Five Year Disposal <br /> Site Review" . This Report of Disposal Site Information <br /> ( "RODSI") was provided pursuant to California Government <br /> Code §§66796 . 33 (d) which provides "Any solid waste facili- <br /> ties permit issued, modified, or revised under this chapter <br /> shall be reviewed and, if necessary, revised at least every <br /> five years. " ' and pursuant to California Administrative <br /> Code Title 14 , §18213 , which provides in full as follows; <br /> 18213. Review of Permits. (a) Except as provided in <br /> Section 18212, every permit shall be due for review <br /> five years after its issuance, most recent modifica- <br /> tion, most recent revision, or most recent review. <br /> The board shall give the operator and the enforcement <br /> agency notice of the review no less than 150 days <br /> before it is due. <br />
