Statement of Facts Forward Inc. Page 3 Regulatory_ Basis The Forward Inc., Post Closure Plan for the hazardous waste unit allows and requires Forward, Inc., to maintain the unit as closed in place in accordance with all of the requirements set forth in: The Resource Conservation and Recovery Act (RCRA) of 1976, as amended by the Hazardous and Solid Waste Act (HSWA) of 1984; the California Health and Safety Code; Title 22 of the California Code of Regulations; and any other more stringent conditions required by DHS and EPA in the final Post Closure Plan to insure protection of public health and the environment. It is the belief of the Department that the proponent's recommended plan will adequately maintain the closure system. The post -closure plan is within the scope of work proposed in the Closure Plan. A Negative Declaration was prepared for the closure plan, fulfilling CEQA requirements for both plans.
