Statement of Facts <br />Forward Inc. <br />Page 3 <br />Regulatory_ Basis <br />The Forward Inc., Post Closure Plan for the hazardous waste <br />unit allows and requires Forward, Inc., to maintain the unit <br />as closed in place in accordance with all of the requirements <br />set forth in: The Resource Conservation and Recovery Act <br />(RCRA) of 1976, as amended by the Hazardous and Solid Waste <br />Act (HSWA) of 1984; the California Health and Safety Code; <br />Title 22 of the California Code of Regulations; and any other <br />more stringent conditions required by DHS and EPA in the final <br />Post Closure Plan to insure protection of public health and <br />the environment. It is the belief of the Department that the <br />proponent's recommended plan will adequately maintain the <br />closure system. The post -closure plan is within the scope of <br />work proposed in the Closure Plan. A Negative Declaration was <br />prepared for the closure plan, fulfilling CEQA requirements <br />for both plans. <br />Public Notice <br />The Forward Inc., Post Closure Plan for the hazardous waste <br />management unit and supplementary documents are available for <br />public review between the hours of 8:00 a.m. and 4:00 p.m., <br />Monday through Friday, at the following locations: <br />Department of Health Services <br />Toxic Substances Control Division <br />Region 1 <br />4250 Power Inn Road <br />Sacramento, CA 95826 <br />(916) 739-3145 <br />U.S. Environmental Protection Agency, Region 9 <br />215 Fremont Street <br />San Francisco, CA 94105 <br />(415) 974-8119 <br />Forward, Inc./Sunrise Disposal <br />1145 West Charter Way <br />Stockton, CA 95206 <br />Stockton Public Library <br />605 North El Dorado <br />Stockton, CA 95206 <br />Written comments will be accepted until October 30, 1989.
