Landfill Permit Review, Facility <br />No. 39 -AA -0015 <br />Dear Mr. Stovall: <br />We`have received your letter regarding the permit review of the <br />Forward, Inc.'Landfill. At issue is the maximum amount of waste <br />the Forward, Inc. Landfill can receive each day. After reviewing <br />the information provided by you, and the information in our <br />facility files, it has been determined that the landfill must <br />operate within the terms and conditions specified in its 1978 <br />Solid Waste Facilities Permit (SWFP). <br />Our determination is based on the following information. The <br />1978 SWFP states the landfill "receives an annual average of 700 <br />cubic yards of non -recyclable wastes per day". Using the <br />conversion factor of 500 pounds per cubic yard, given in the 1978 <br />Report of Disposal Site Information, the landfill could receive <br />up to 175 tons of waste per day. Receipt of greater than 175 <br />tons per day will require a permit revision. <br />As we have previously discussed, the revision of a SWFP will <br />require review pursuant to the California Environmental Quality <br />Act (CEQA). The 1972 Environmental Impact Statement (EIS), and <br />the 1972 Geotechnical Investigation and Waste Management Study <br />are not adequate for the California Waste Management Board to use <br />in considering a revision of the SWFP, or for the Determination <br />of Conformance with the County Solid Waste Management Plan <br />(CoSWMP). Board legal counsel have advised us that neither the <br />EIS nor the geotechnical study should be considered as CEQA <br />equivalent documents. <br />Thank you for providing us with the <br />;comment.
