The following is an itemized list of underground storage tank violations that have not <br /> been addressed for H&M - BW #98 as of December 27, 2023. <br /> Open violations from July 19, 2023 inspection <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#214-Failure to comply with UST operating permit conditions. <br /> OBSERVATION: The VMI leak detector was replaced with a Red Jacket and a permit was not obtained from the <br /> EHD. <br /> REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be <br /> performed by a properly licensed, trained, and certified contractor pursuant to the EHD's policy and a permit <br /> obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by <br /> the EHD prior to beginning work. <br /> CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the VMI replacement. A"Failure to Obtain a <br /> Permit"penalty applies. <br /> OBSERVATION: The facility is not in compliance with the written conditions of the operating permit. Per the Service <br /> Request(SR0084893), the verification of ball float was not scheduled. <br /> REGULATION GUIDANCE: The owner and operator of underground storage tank(UST)systems shall comply with <br /> all requirements of the permit issued for the operation of the UST system. <br /> CORRECTIVE ACTION: Immediately take all necessary actions to bring these UST systems into compliance. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#308-Failure of the leak detection equipment to have an audible and visual alarm. <br /> OBSERVATION: Observed the float and chains in the 1-2 UDC did not trip to stop the flow of product at the <br /> dispenser. <br /> REGULATION GUIDANCE: All monitoring equipment shall be maintained to activate an audible and visual alarm or <br /> stop the flow of product at the dispenser when it detects a leak. <br /> CORRECTIVE ACTION: Correct immediately by having a properly licensed, trained, and certified contractor replace <br /> the failed component with a functional component(LG 113-x listed, if applicable), and obtain a permit within one <br /> business day from the EHD, if needed. If the failed component can't be replaced immediately, there is a possibility <br /> that the 87 UST system may be red tagged to prevent fuel inputs. <br /> Page 2 of 3 <br />
