4 Environmental Analysis <br /> 4.11 Land Use and Planning <br /> Division 1, Section 9-115.580. Division 6, Section 9-605.2, of the San Joaquin County Municipal <br /> Ordinance Code allows major utilities on AG zoned land through a Site Approval application. The <br /> Applicant has applied to the San Joaquin County Community Development Department for a Site <br /> Approval to allow for the Project. <br /> Title 6— Public Welfare; Division 5 — Underground Utilities <br /> Division 5 of the San Joaquin County Municipal Code of Ordinances sets forth regulations for <br /> underground utility districts within the County, to enhance public welfare through the removal of <br /> poles and overhead wires and to place utilities underground. Per Section 6-5005, this chapter <br /> does not apply to poles, overhead wires, and associated overhead structures used for the <br /> transmission of electric energy at nominal voltages in excess of 34.5 kilovolts (kV). The proposed <br /> gen-tie line would be 230 kV and, therefore, would not require underground installation. <br /> Agriculture Mitigation Ordinance <br /> The County's Agriculture Mitigation Ordinance is defined in Title 9, Division 10, Chapter 9-1080, <br /> of the Municipal Ordinance Code. The purpose of the County's Agriculture Mitigation Ordinance <br /> is to permanently protect agricultural land in the County by mitigating the loss of agricultural land <br /> resulting from: <br /> 1) A General Plan Amendment that changes the designation of any land from an agricultural <br /> to a non-agricultural use; and <br /> 2) A Zoning Reclassification that changes the permitted uses from agriculture to a non- <br /> agricultural use, regardless of the General Plan designation. <br /> Mitigation is required in the form of an agricultural conservation easement that protects the same <br /> number of acres proposed to be changed to a non-agricultural use, or greater (1:1 ratio). If <br /> easement acquisition is determined to be infeasible after a good faith effort, a payment in lieu <br /> may be allowed (FIC 2022). <br /> Alameda County East County Area Plan <br /> Alameda County's General Plan consists of several documents, including three area plans which <br /> include goals and policies for land use, circulation, open space, conservation, safety, and noise <br /> specific to their respective geographic areas. The County's General Plan also consists of <br /> countywide elements for Housing, Conservation, Open Space, Noise, Seismic Safety, and Scenic <br /> Routes. Area plans address area-specific issues that affect both unincorporated and incorporated <br /> areas, but have legal regulatory effect only within currently unincorporated areas. Countywide <br /> elements address broader issues on a countywide basis and provide a comprehensive and <br /> consistent policy framework for the more specific area plans (Alameda County 2000). The East <br /> County Area Plan (ECAP) is a portion of the Alameda County General Plan that is specific to the <br /> eastern portion of the County. The purpose of the ECAP is to present a clear statement of <br /> Alameda County's intent concerning future development and resource conservation within East <br /> County. The goals and policies in the ECAP are intended to inform decision-makers, the general <br /> public, public agencies, and those doing business in Alameda County of the County's position on <br /> land use-related issues and to provide guidance for day-to-day decision-making.
