4 Environmental Analysis <br /> 4.11 Land Use and Planning <br /> Goal: To minimize the risks to lives and property due to seismic and geologic hazards. <br /> Policy 309: The County shall not approve new development in areas with potential for <br /> seismic and geologic hazards unless the County can determine that feasible measures <br /> will be implemented to reduce the potential risk to acceptable levels, based on site-specific <br /> analysis. The County shall review new development proposals in terms of the risk caused <br /> by seismic and geologic activity. <br /> Policy 310: The County, prior to approving new development, shall evaluate the degree <br /> to which the development could result in loss of lives or property, both within the <br /> development and beyond its boundaries, in the event of a natural disaster. <br /> Policy 311: The County shall ensure that new major public facilities, including emergency <br /> response facilities (e.g., hospitals and fire stations), and water storage, wastewater <br /> treatment and communications facilities, are sited in areas of low geologic risk. <br /> Policy 313: The County shall require development in hilly areas to minimize potential <br /> erosion and disruption of natural slope stability which could result from grading, vegetation <br /> removal, irrigation, and drainage. <br /> Goal: To minimize the risks to lives and property due to fire hazards. <br /> Policy 320: The County shall consider, in reviewing development projects and subdivision <br /> of agricultural lands, the severity of natural fire hazards, potential damage from wildland <br /> and structural fires, the adequacy of fire protection services, road access, and the <br /> availability of an adequate water supply and pressure. <br /> Alameda County Zoning Ordinance and Municipal Code of Ordinances <br /> Zoning <br /> The portion of the Project site in Alameda County, where the proposed gen-tie transmission line <br /> and the proposed tie-in to the existing PG&E Tesla Substation would be located are zoned as <br /> Agriculture (A). Pursuant to Section 17.06.010 of the Alameda County Zoning Ordinance, <br /> agricultural districts are established to promote implementation of general plan land use proposals <br /> for agricultural and other nonurban uses, to conserve and protect existing agricultural uses, and <br /> to provide space for and encourage such uses in places where more intensive development is <br /> not desirable or necessary for the general welfare. However, Section 17.52.020 of the Alameda <br /> County Zoning Ordinance allows for public utility uses (except for buildings, service yards, and <br /> storage yards) in any zoning district without limitation as to height provided that plans for such <br /> uses be submitted to the Planning Commission for a report and recommendation prior to the <br /> acquisition of any site, easement, or right-of-way (ROW). Accordingly, the proposed gen-tie <br /> transmission line would be permitted by right within the Alameda County Agriculture zoning district <br /> if a Utility Roadway Permit were not required (see below). <br /> Title 12 — Public Roadways and Parks; Chapter 12.08 — Roadway Use Regulations <br /> Chapter 12.08 of the Alameda County Municipal Code of Ordinances sets forth regulations for <br /> development within and along public roadways.
