4 Environmental Analysis <br /> 4.11 Land Use and Planning <br /> as encroachments, subject to the permitting requirements of this chapter. Encroachment permits <br /> are issued at the discretion of the director, subject to the requirements of this chapter. The Project <br /> would be required to apply for a Utility Roadway Permit for development of the proposed gen-tie <br /> transmission line, which is intended to authorize public and private utility agencies and companies <br /> to encroach upon public roadways. This includes Midway Road, which is parallel to the west <br /> Project site boundary. Approval of such an encroachment permit would be a discretionary action, <br /> making Alameda County a Responsible Agency for the Project, pursuant to CEQA Section 15381. <br /> Title 13 — Public Services; Chapter 13.16 — Underground Utility Districts <br /> Chapter 13.16 of the Alameda County Municipal Code of Ordinances sets forth regulations for <br /> underground utility districts within the County to enhance public welfare through the removal of <br /> poles and overhead wires, and to place utility distribution facilities underground, primarily within <br /> urbanized areas. Per Section 13.16.030, "utility distribution facilities" do not include wires carrying <br /> voltages higher than 35 kV. The proposed gen-tie line would be 230 kV and, therefore, would not <br /> require underground installation. <br /> Alameda County Measure D <br /> In November 2000, the Alameda County electorate approved the Save Agriculture and Open <br /> Space Lands Initiative (Measure D; effective date, December 22, 2000). The Initiative amended <br /> portions of the County General Plan, including the ECAP. The Initiative added policies pertaining <br /> specifically to the North Livermore area to allow for more intensive agricultural uses in this area <br /> with the goal to permit and encourage cultivated agriculture and to preclude urbanization without <br /> unduly impairing the open and natural qualities of the area. The Urban Growth Boundary was also <br /> redrawn to remove North Livermore from urban development, and North Livermore, west of <br /> Dagnino Road, was delineated as an Intensive Agriculture area. Lands previously designated <br /> Urban Reserve were redesignated as LPA, and land use policies for LPA, Resource Management <br /> (RM), and Rural Residential (RR) designations are more restrictive. The Initiative restricts areas <br /> outside of the urban growth boundary to agricultural, natural resource, and rural areas, and <br /> prevents the construction of infrastructure to support any urban development. Measure D also <br /> prohibits the County from providing or authorizing expansion of public facilities or other <br /> infrastructure that would create more capacity than needed to meet the development allowed by <br /> the Initiative. The Initiative does not prohibit public facilities or other infrastructure that have no <br /> excessive growth-inducing effect on the East County area and have permit conditions to ensure <br /> that no service can be provided beyond that consistent with development allowed by the Initiative <br /> (Alameda County 2000). <br /> Alameda County voters also passed an update to Measure D on November 8, 2022, which <br /> increased the allowable size of certain agricultural buildings and equestrian arenas within the LPA <br /> and RM designations (Alameda County 2022). <br /> 4.11.3 Thresholds of Significance <br /> A project would result in significant impacts to land use and planning if it would: <br /> a) Physically divide an established community; or <br /> b) Cause significant environmental impact due to a conflict with any land use plan, policy, or <br /> regulation adopted for the purpose of avoiding or mitigating an environmental effect. <br /> Griffith Battery Energy Storage Project 4.11-16 Tetra Tech/SCH 2022120675 <br /> Draft Environmental Impact Report August 2023 <br />
