The local program is responsible for ensuring that all employee housing accommodations meet
the minimum State requirements established for use, maintenance, occupancy, and safety.
Beginning in 2000, EHD granted all dairy facilities an exemption from the requirement to obtain an
annual Permit to Operate employee housing. EHD records show that your facility was one of the
facilities granted an exemption.
However, as a result of a recent review of our local Employee Housing Program, HCD provided
clarification that the exemption in State law is limited to detached, permanent single family dwellings
only.' Dairy facilities with duplexes or triplexes are not eligible for exemption. EHD was directed to
implement the annual Permit to Operate requirements for those dairy facilities with duplex or triplex
employee housing accommodations.
According to EHD records, your dairy facility has the following employee housing accommodations:
Quantity Housing Type Year Built
1 Duplex 1985
1 Single Family Dwelling 1920
3 Single Family Dwelling Pre-1985
2 Mobilehome Unit Pre-1985
1 Mobilehome Unit 1997
1 California Health and Safety Code,Sections 17030—17031.
