Hazelton Ave <br /> Stockton, CA 95205-6232 <br /> 15 September 2014 <br /> RE: Forward Resource Recovery Facility—Request for waiver of statutory timelines for solid waste <br /> facility permit revision <br /> Dear Mr. McClellon: <br /> Forward Incorporated (Forward) is requesting a waiver of statutory timelines for a solid waste facility <br /> permit revision. <br /> To allow the California Department of Resources Recovery and Recycling additional time to consider <br /> the proposed revised solid waste facilities permit for the Forward Resource Recovery Facility <br /> Transfer/Processing Station/etc. (SWIS # 39-AA-0020), as the applicant for the permit, hereby <br /> expressly waives the time for San Joaquin County Environmental Health Department, the Local <br /> Enforcement Agency ("LEA"), to consider the permit application under Public Resources Code <br /> Section 44008 and for CalRecycle to consider the proposed permit under Public Resources Code <br /> Section 44009 and under any CalRecycle regulations which implement or interpret those statutes or <br /> otherwise set time periods for CalRecycle or the LEA to review and act on a permit application or a <br /> proposed permit. As the applicant, we request that the CalRecycle postpone its consideration of the <br /> proposed permit until 18 October 2014. This waiver terminates on 18 October 2014, unless we <br /> extend it by a writing delivered to the LEA and CalRecycle. <br /> I certify under penalty of law, that I have personally examined and am familiar with the information <br /> submitted in this document and all attachments, and that based on my inquiry of those individuals <br /> immediately responsible for obtaining this information, I believe that the information is true, accurate, <br /> and complete.
