This is a <br />response to that letter. The letter referenced Public Resources Code (PRC), Section 44307. PRC, Section 44307 <br />requires that the LEA convene a hearing panel and hold a hearing regarding the Local Enforcement Agency (LEA) <br />failure to act. Is that your intent? I contacted your office several times last week to find out if that was the case. <br />My calls were never returned. At this point the permit has not been issued. If there is a condition that can be <br />placed into the permit to address your concerns I would be happy to work with you or your staff to make those <br />changes. <br />The EHD understands that there are concerns that the changes might lead to additional traffic congestion. The <br />permit revision does not include change to allow additional vehicles at the facility. The slowed economy has <br />created a situation where the maximum number of trucks is rarely seen. Currently the Landfill and Transfer <br />Station are approved to accept 620 trucks per day. <br />The increased combined tonnage at the Transfer Station will not increase the amount of waste that facility can <br />accept. The Transfer Station and Compost site have design volumes that are listed in the permit, as well as, the <br />Transfer Processing Report (TPR) and Report of Composting Site Information (RCSI). The facility operator will <br />not be allowed to exceed those limits. The change to the combined tonnage will allow the Transfer Station to <br />remain open on days when the tonnage for both facilities exceeds 4180 tons. Currently the Forward Inc. Landfill <br />is allowed and permitted to accept 8668 tons per day, but there again due to the slow economy that number is <br />not often realized. <br />The Landfill and Transfer Station are both equipped with wheel washers. The Transfer Station has also received <br />additional improvements to the entrance. The improvements have reduced the off- site tracking of mud and <br />debris. During a recent storm, December 11, and December 12, 2014, Austin Road was monitored by the EHD <br />staff. The site was using both wheel washers and operating the street sweeper during that time. The EHD staff <br />was unable to document excessive mud and debris on Austin Road. <br />The landfill and Transfer Station have a Litter Management Plan (LMP). The LMP requires that all loads accepted <br />at the landfill be covered (tarped) when entering and exiting the facility. The LMP also requires the use of litter <br />
