AGREEMENT ESTABLISHING A PLEDGE OF REVENUE FOR POST -CLOSURE MAINTENANCE AT THE CORRAL HOLLOW SANITARY LANDFILL This agreement establishes a Pledge of Revenue to assure that adequate funds are available to cant' out the Postclosure Maintenance at the closed Corral Hollow Sanitary Landfill. This Agreement shall become effective immediately, and is made and entered into by and between County of San Joaquin, a political subdivision of the State of California, and the California Integrated Waste Management Board (CIWMB). WHEREAS, Public Resources Code, sections 43500 through 43610.1 and Title 27, California Code of Regulations (Regulations), Division 2, Subdivision 1, Chapter 6, require operators of solid waste landfills to demonstrate the availability of financial resources to conduct postclosure maintenance; and, WHEREAS, sections 22228 and 22245 of the Regulations specify a Pledge of Revenue as an acceptable mechanism to demonstrate financial responsibility for postclosure maintenance costs of a solid waste landfill; and, WHEREAS, the County operates the Corral Hollow Sanitary Landfill, a closed solid waste landfill, in conformance with the findings, conditions, prohibitions and requirements contained in Solid Waste f=acilities Permit No. 39 -AA -0005, issued by San Joaquin County Department of Environmental Health serving as the Local Enforcement Agency for the California Integrated Waste Management Board; and, WHEREAS, the County is pledging revenues from tipping fees of the North County Recycling Center and Sanitary Landfill (Solid Waste Facility Permit 39 -AA -0022), the Foothill Sanitary Landfill (Solid Waste Facility Permit 39 -AA -0004), the. Lovelace Recycling Center (Solid Waste Facility Permit 39 -AA -008), and other revenue sources that the Solid Waste Enterprise Fund may have, such revenues being deposited into the Solid Waste Enterprise Fund of San Joaquin County; and, WHEREAS, County has determined that projected net revenues from these sources during the 30 year postclosure maintenance period, will, during each*year of this period, be greaterthan the yearly monitoring and postclosure maintenance costs. NOW THEREFORE, San Joaquin County and the CIWMB do agree as follows: 1. The County hereby establishes a Pledge of Revenue to demonstrate financial responsibility. for postclosure maintenance costs of the Corral Hollow Sanitary Landfill in accordance with sections 22228 and 22245 of the Regulations. 2. The County agrees to pledge net revenues from the sources of funds described herein. 3. The amount of the pledged revenue shall be equal to $82,600 per year, for. the 30 year period of postclosure maintenance, representing the most recent annual monitoring, and postclosure maintenance costs for the Corral Hollow Sanitary Landfill. It is agreed that the amount of this pledge may increase, or decrease to match any adjustment to the identified costs, which is mutually agreed to by the County and the CIWMB.
