Elm <br />BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br />STATE OF CALIFORNIA <br />RESOLUTION <br />PLEDGE OF REVENUE FOR POST -CLOSURE <br />MAINTENANCE AT THE CLOSED CORRAL HOLLOW SANITARY LANDFILL <br />WHEREAS, Public Resources Code, sections 43500 through 43610.1 and Title 27, <br />California Code of Regulations (Regulations), Division 2, Subdivision 1, Chapter 6, require operators <br />of solid waste landfills to demonstrate the availability of financial resources to conduct postclosure <br />maintenance; and, <br />WHEREAS, sections 22228 and 22245 of the Regulations specify a Pledge of Revenue as an <br />acceptable mechanism to demonstrate financial responsibility for postclosure maintenance costs of a <br />solid waste landfill; and, <br />WHEREAS, the County of San Joaquin owns and maintains the closed Corral Hollow Sanitary <br />Landfill in conformance with the findings, conditions, prohibitions and requirements contained in Solid <br />Waste Facilities Permit No: 39 -AA -0005, issued by The County of San Joaquin Department of <br />Environmental Health serving as the Local Enforcement Agency for the California Integrated Waste <br />Management Board; and, <br />WHEREAS, the County of San Joaquin is pledging revenues from tipping fees of the North <br />County Recycling Center and Sanitary Landfill (Solid Waste Facility Permit 39 -AA -0022), the Foothill <br />Sanitary Landfill (Solid Waste Facility Permit 39 -AA -0004), the Lovelace Recycling Center (Solid <br />Waste Facility Permit 39 -AA -008), and other revenue. sources that the Solid Waste Enterprise Fund <br />may have, such revenues being deposited into the Solid Waste Enterprise Fund of The County of <br />San Joaquin; and, <br />WHEREAS, the County of San Joaquin has determined that projected net revenues from <br />these sources during the 30 year period of postclosure maintenance period, will, during each. year of <br />this period, be greater than the yearly monitoring and postclosure maintenance costs, and, <br />NOW THEREFORE, BE IT RESOLVED, by the.Board of Supervisors of the County of <br />San Joaquin that: <br />1. The County of San Joaquin shall establish a pledge of revenue to demonstrate financial <br />responsibility for postclosure maintenance costs of the Corral Hollow Sanitary Landfill in accordance <br />with sections 22228 and 22245 of the Regulations. <br />2. If the California Integrated Waste Management Board (CIWMB) determines that the County <br />has failed, or is failing, to perform postclosure maintenance as required by law, then the CIWMB may <br />direct the Auditor -Controller of the County to pay to the Director of Public Works from the pledged <br />revenues sufficient funds to ensure postclosure maintenance, who then shall be obligated to use such <br />funds for postclosure maintenance in accordance with the directives of the CIWMB. <br />
