OBSERVATION:The facility failed to prepare an SPCC Plan that meets all applicable requirements. -The SPCC Plan does not address 112.8(d)(5) REGULATION GUIDANCE:25270.4.5 (a)Except as provided in subdivision (b),the owner or operator of a storage tank at a tank facility subject to this chapter shall prepare a spill prevention control and countermeasure plan applying good engineering practices to prevent petroleum releases using the same format required by Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations, including owners and operators of tank facilities not subject to the general provisions in Section 112.1 of those regulations.An owner or operator specified in this subdivision shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator specified in this subdivision shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. 112.3:The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan in accordance with§ 112.7 and any other applicable section of this part. CORRECTIVE ACTION: Ensure that facility's SPCC plan meets all applicable requirements. OBSERVATION:The Spill Prevention, Control, and Countermeasure(SPCC)Plan was not implemented, as required (applicable sections of the SPCC Plan are included below). 4.4, 5.2, 6.5: Spill kit observed empty in 55-gallon drum storage area without equipment listed in the SPCC plan 4.4, 5.1, 6.5: Spill kits were not found in proximity of all ASTs. The only spill kit near ASTs was located was located in the 55-gallon drum storage area. 4.1,4.4.1, 5.2.2: A 55-gallon drum labeled Rotella T Oil 40 was observed located directly on the floor, not located on a spill pallet as specified in the plan. 5.2.8: Monthly testing of liquid-level gauges on applicable ASTs REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or "Plan")," in accordance with § 112.7 and any other applicable section. 25270.4.5.(a):An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations.
