• The California Department of Toxic Substances Control <br />(DTSC) protects people and the environment from harmful <br />effects of toxic substances by: <br />▪Enforcing hazardous waste regulations <br />▪Performing inspections of permitted facilities and hazardous <br />waste generators <br />▪Taking enforcement actions to ensure compliance <br />Hazardous Waste & Universal Waste Management <br />In 1992 California became an authorized state. California’s regulations covering the <br />management, transportation, and disposal of hazardous waste for generators in California <br />are outlined in California Code of Regulations, Title 22, Division 4.5. In many instances, <br />California’s hazardous waste program is much more stringent than the federal RCRA <br />hazardous waste program. DTSC is the California department that is responsible for <br />implementing and enforcing the State’s hazardous waste regulations, inspecting facilities in <br />California that are permitted to treat, store, and dispose of hazardous waste, inspecting <br />companies that are registered to transport hazardous waste in the State as well as sites <br />where hazardous waste is generated. DTSC has the authority to take enforcement actions <br />to ensure that companies are complying with the State’s hazardous waste program. <br />While DTSC is the State’s department for implementing California’s hazardous waste <br />program, it will be the CUPA, San Joaquin County Environmental Health Department, that <br />inspects our facilities for compliance with hazardous waste regulations. Violations of the <br />State’s hazardous waste program can result in penalties of up to $70,000 per violation per <br />day. <br />37
