Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />January 13, 2025 <br /> Facility Address: <br /> 400 S LINCOLN ST, STOCKTON <br /> Facility Name: <br /> KNIFE RIVER <br /> □ OUT □ R □ COS4045 - Release/Leaks/Spills - General Local Ordinance 86 <br /> □ OUT □ R □ COS4050 - Abandonment/Illegal Disposal/Unauthorized Treatment - General See below 87 <br /> □ OUT □ R □ COS4055 - Abandonment/Illegal Disposal/Unauthorized Treatment - General Local Ordinance 88 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />Code of Fed Regulations 112.3 4030038 - SPCC has been implemented. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not fully implemented, as <br />required. 1) Records of training for Joe Lima, Shop Mechanic were not available during the inspection. 2) Records of <br />inspections for the last three years for the three 275 gallons oil tanks, and portable 55 gallons drums were not <br />available during inspection. 3) The December 2024 inspection record for the 10,000 gallons Diesel Tank was not <br />available during the inspection. 4) Technical Amendment for 2022 SPCC plan revision were not certified by the PE. <br />REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must <br />prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or <br />“Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall <br />conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) <br />of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control <br />and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in <br />Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. <br />CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the issued 1-3 <br />discussed above. <br />This is (Class 2) Violation. <br /> 3 <br />Code of Fed Regulations 112.5(a), 112.5(b) 4030039 - SPCC has been implemented within 6 months of amendment. <br />OBSERVATION: The following technical amendments were made to the SPCC plan in 2022 as part of the return to <br />compliance for inspection conducted by EHD on 3/01/2022, however, the plan was not certified by the PE. <br />1) Seven empty ASTs were observed during the last inspection on 03/01/2022. These tanks were removed from the <br />site. <br />2) Section 15(6) of the SPCC plan was updated to reflect the current practices for integrity inspection(s) <br />3) The 2021 SPCC plan had six to ten 55 gallons drums of oil. The plan was amended in 2022 to increase the number <br />of drums to eight to fourteen 55 gallons drums and the facility diagram was updated as well. <br />REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in <br />§ 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility <br />design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § <br />112.1(b). Examples of changes that may require amendment of the Plan include, but are not limited to: commissioning <br />or de commissioning containers; replacement, reconstruction, or movement of containers; reconstruction, <br />replacement, or installation of piping systems; construction or demolition that might alter secondary containment <br />structures; changes of product or service; or revision of standard operation or maintenance procedures at a facility.
