Environmental Health Department <br />CP22 - HMBP Inspection Report <br />Date: <br />January 09, 2025 <br /> Facility Address: <br /> 8100 N PODESTA LN, LINDEN <br /> Facility Name: <br /> FRED PODESTA FARMS <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />facility's business plan. <br />CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval. <br />This is a repeat violation (Class 2) Violation. <br />CA Health and Safety Code 25505(a)(2) 1010005 - Site Map with all required content electronically submitted. <br />OBSERVATION1: The site map is not complete with all the required elements. The site map does not address the <br />locations of the storm drains/Yard drains. Facility has marked N/A to storm drains on the site map . <br />OBSERVATION 2: Farming Operation Chemicals are not included on the site map. The following chemicals were not <br />included on the site map: Multiple 55 gallons drums./barrels of oil contaminated possibly with rain water, 5 gallons <br />bucket, 30 gallons barrels, 500 gallons tank of Gasoline, 5 Tanks of Diesel (1,000 gallons each), 55 gallons drum of <br />oil, 6 barrels of PAA, and two drums of Acetone. <br />REGULATION GUIDANCE: site map that contains north orientation, adjacent streets, access and exit points, <br />evacuation staging areas, hazardous material handling and storage areas, emergency response equipment, and, if <br />present, loading areas, internal roads, storm and sewer drains, and emergency shutoffs , as well as additional map <br />requirements the governing body of the unified program agency finds necessary. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is a repeat violation (Class 2) Violation. <br /> 11 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: Farm Operators/employees are not trained on oil spill and managing used oil disposal. Observed <br />multiple used oil containers open. Observed contaminated soil with oil. No Clean-up has been done. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or <br />threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and <br />procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the <br />unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential <br />harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate <br />notice, for the business site.
