Copies of inspection and testing records for 2023, 2024, and 2025 were not found on site. <br />REGULATION GUIDANCE: 112.7(e), Conduct inspections and tests required by this part in accordance with written <br />procedures that you or the certifying engineer develop for the facility. You must keep these written procedures and a <br />record of the inspections and tests, signed by the appropriate supervisor or inspector, with the SPCC Plan for a period of <br />three years. Records of inspections and tests kept under usual and customary business practices will suffice for <br />purposes of this paragraph. 112.8(c)(6) Test or inspect each aboveground container for integrity on a regular schedule <br />and whenever you make material repairs. <br />CORRECTIVE ACTION: Inspections and tests must be conducted in accordance with the written procedures developed <br />in the Spill Prevention, Control, and Countermeasure (SPCC) Plan. Records of these inspections and tests must be <br />signed by the appropriate supervisor or inspector and kept on-site with the SPCC Plan for three years. Immediately <br />locate a copy of all inspection and testing records for the last three years, maintain them on-site, and submit copies to the <br />EHD. <br />This is a Repeat (Class 2) Violation. <br />77 <br />Code of Fed Regulations 112.1(b)(3), 112.2 4030036 - All/any permanently closed tanks are properly closed under the <br />definition in 40 CFR 112.2 <br />OBSERVATION: The two 10,000 gallon DW ASTs are not in use but has not been properly closed. As per Juan <br />Gutierrez, the two 10,000 gallon ASTs are no longer in use. <br />REGULATION GUIDANCE: When a tank is not in use, it must be permanently closed by meeting the following <br />conditions: <br />- remove all liquid and sludge from each container and connecting line <br />- disconnect and blank off all connecting lines and piping have from the tank/ container <br />- close and lock all valves <br />- post a sign conspicuously stating that it is a permanently closed container and denoting the date of closure. <br />CORRECTIVE ACTION: Tanks that are not being used or are not addressed in the Spill Prevention, Control, and <br />Countermeasure (SPCC) Plan must either be included in your plan or meet the permanent closure requirements noted <br />above. Provide verification to the EHD of proper closure of the tanks. <br />This is a (Minor) Violation. <br />79 <br />CA Health and Safety Code 25404(e)(4) 4010 - Administration/Documentation - General <br />OBSERVATION: A submission to the California Environmental Reporting System (CERS) for the Aboveground <br />Petroleum Storage Act (APSA) program has not been made. The SPCC certification/5-year review date in the APSA <br />element on CERS is out of date and greater than 5 years. <br />REGULATION GUIDANCE: 25404(e)(4) No later than three years after the statewide information management system is <br />established, each CUPA, PA, and regulated business shall report program data electronically. The secretary shall work <br />with the CUPAs to develop a phase-in schedule for the electronic collection and submittal of information to be included in <br />the statewide information management system, giving first priority to information relating to those chemicals determined <br />by the secretary to be of greatest concern. The secretary, in making this determination shall consult with the CUPAs, the <br />California Emergency Management Agency, the State Fire Marshal, and the boards, departments, and offices within the <br />California Environmental Protection Agency. <br />CORRECTIVE ACTION: Beginning January 1, 2013, all businesses are required to submit all new (or any changes to <br />existing) Aboveground Petroleum Storage Act (APSA) information online to the CERS at http://cers.calepa.ca.gov. Be <br />sure to include your APSA activity in the Businesses Activities section in CERS in addition to any other relevant activities <br />and required fields.
