Environmental Health Department <br />AMENDED <br />6/2/2025 <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />May 19, 2025 <br /> Facility Address: <br /> 12505 E BRANDT RD, LOCKEFORD <br /> Facility Name: <br /> FORD CONSTRUCTION COMPANY - BRANDT <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />REGULATION GUIDANCE: 112.7(e), Conduct inspections and tests required by this part in accordance with written <br />procedures that you or the certifying engineer develop for the facility. You must keep these written procedures and a <br />record of the inspections and tests, signed by the appropriate supervisor or inspector, with the SPCC Plan for a period <br />of three years. Records of inspections and tests kept under usual and customary business practices will suffice for <br />purposes of this paragraph. 112.8(c)(6) Test or inspect each aboveground container for integrity on a regular schedule <br />and whenever you make material repairs. <br />CORRECTIVE ACTION: Inspections and tests must be conducted in accordance with the written procedures <br />developed in the Spill Prevention, Control, and Countermeasure (SPCC) Plan. Records of these inspections and tests <br />must be signed by the appropriate supervisor or inspector and kept on-site with the SPCC Plan for three years. <br />Immediately locate a copy of all inspection and testing records for the last three years, maintain them on-site, and <br />submit copies to the EHD. <br />This is (Class 2) Violation. <br />Code of Fed Regulations 112.8(d)(5) 4030031 - Vehicle traffic warned of aboveground piping or other oil transfer <br />operations. <br />OBSERVATION: The facility failed to adequately warn vehicle traffic about the 10,000-gallon red diesel AST , located on <br />the north-west side of the site and used for oil transfer operations. According to the SPCC plan Section 6.2, "the large <br />diesel tank and fuel dispensing equipment are protected from vehicles and equipment by the placement of concrete <br />blocks around the tank and fueling area." However, not all sides of the diesel and fuel dispensing equipment were <br />protected with concrete blocks. <br />REGULATION GUIDANCE: (d)(5) Warn all vehicles entering the facility to be sure that no vehicle will endanger <br />aboveground piping or other oil transfer operations. <br />CORRECTIVE ACTION: Provide adequate warning to all vehicle traffic about the 10,000-gallon diesel AST. Provide <br />proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 71 <br />Code of Fed Regulations 112.1(b)(3), 112.2 4030036 - All/any permanently closed tanks are properly closed under the <br />definition in 40 CFR 112.2. <br />OBSERVATION: The 2,000 gallon red diesel tank labeled empty and permanently closed does not follow the <br />requirements for permanently closed tanks: the tank was not labeled with the empty date, and locks were not <br />observed on all valves. Liquid and sludge removal was unverifiable. Additionally, the SPCC plan was not amended to <br />permanently close the tank. <br />REGULATION GUIDANCE: When a tank is not in use, it must be permanently closed by meeting the following <br />conditions: <br />- remove all liquid and sludge from each container and connecting line <br />- disconnect and blank off all connecting lines and piping have from the tank / container <br />- close and lock all valves <br />- post a sign conspicuously stating that it is a permanently closed container and denoting the date of closure. <br /> 77 <br />FA0018219 PR0526901 SC001 05/19/2025 <br />EHD Rev. 12/06/2021 CP22 - AST Non-Qualified OIRPage 6 of 8 <br />1868 E.
