<br /> <br />North County Recycling Center and Sanitary Landfill Permit Revision Project <br />Final Initial Study/Mitigated Negative Declaration · San Joaquin County | May 2025 <br />45 <br /> <br />ENVIRONMENTAL SETTING <br />The project site is classified as a Class III Waste Management Unit and designated for "non- <br />hazardous solid waste." The landfill accepts agricultural, residential, commercial, industrial, <br />construction and demolition debris, yard waste, tires, and wood waste. Recyclable material is <br />also accepted. The County maintains a load check program at the facility’s entrance to ensure <br />all materials brought to the landfill comply with State and local regulations. Furthermore, the <br />County has a separate landfill that accepts hazardous waste which operates independently from <br />North County Landfill. <br />REGULATORY SETTING <br />California Code of Regulations Title 27 § 20260 <br />Class III landfills shall be located where site characteristics provide adequate separation <br />between nonhazardous solid waste and waters of the state. Class III landfills are subject to State <br />waste containment requirements and SWRCB requirements. New Class III and existing Class II-2 <br />landfills shall be sited where soil characteristics, distance from waste to ground water, and other <br />factors will ensure no impairment of beneficial uses of surface water or of ground water beneath <br />or adjacent to the landfill. <br />California Code of Regulations Title 27 § 20220 <br />Non-hazardous solid waste are defined as “a ll putrescible and non-putrescible solid, semi-solid, <br />and liquid wastes, including garbage, trash, refuse, paper, rubbish, ashes, industrial wastes, <br />demolition and construction wastes, abandoned vehicles and parts, discarded home and <br />industrial appliances, manure, vegetable or animal solid and semi-solid wastes and other <br />discarded waste (whether of solid or semi-solid consistency); provided that such wastes do not <br />contain wastes which must be managed as hazardous wastes, or wastes which contain soluble <br />pollutants in concentrations which exceed applicable water quality objectives, or could cause <br />degradation of waters of the state (i.e., designated waste).” <br /> <br />Nonhazardous solid waste may be discharged at any classified landfill which is authorized to <br />accept such waste, provided that (1) the co-disposal of nonhazardous solid waste with other <br />waste shall not create conditions which could impair the facility’s containment features and shall <br />not render designated waste hazardous, and (2) the facility shall ensure to the maximum extent <br />feasible, that only those wastes that are approved for being discharged at that facility. <br />San Joaquin County General Plan – Hazardous Materials and Wastes <br />Policy PHS-7.3 Control Hazardous Materials: The County shall require the use, storage, and <br />disposal of hazardous materials and wastes to comply with local, State, and Federal safety <br />standards. <br /> <br />Policy PHS-7.5 Locate Hazardous Materials Away from Populated Areas: To the extent feasible, <br />the County shall require proposed activities and land uses that use, store, or dispose of <br />hazardous materials or wastes to be located away from existing and planned populated areas. <br /> <br />Policy PHS-7.7 County Hazardous Materials Area Plan: The County shall maintain and implement <br />the County Hazardous Materials Area Plan for emergency response to a release or threatened <br />release of hazardous material within the unincorporated County.
