State can rely naming the State as an additional insured (or proof of a policy <br /> endorsement which names the State as an additional insured), with evidence of <br /> insurance as follows: <br /> Commercial General Liability: Permittee shall maintain general liability on an <br /> occurrence form with limits not less than $5,000,000 per occurrence and $5,000,000 <br /> aggregate for bodily injury and property damage liability. The policy shall include <br /> coverage for liabilities arising out of Premises, operations, independent contractors, <br /> products, completed operations, personal, and advertising injury, and liability assumed <br /> under an insured agreement. This insurance shall apply separately to each insured <br /> against whom claim is made, or suit is brought subject to the Permittee's limit of liability. <br /> The policy must name The STATE OF CALIFORNIA, its officers, agents, and <br /> employees as an additional insured, but only with respect to work performed under <br /> this Agreement, via blanket-form endorsement. <br /> Automobile Liability: The Permittee, if performing work under this Agreement, shall <br /> maintain motor vehicle liability with limits of not less than $5,000,000 combined single <br /> limit (CSL) with respect to liability arising out of all owned, hired, and non-owned autos. <br /> The policy must name STATE OF CALIFORNIA, its officers, agents, and employees <br /> as additionally insured. The blanket-form additional insured endorsement shall be <br /> provided. <br /> Workers' Compensation: The Permittee, or such contractor, agent, consultant, or sub- <br /> consultant retained by Permittee to perform the work shall maintain statutory workers' <br /> compensation and employer's liability. The employer's liability shall have a limit of <br /> $1,000,000. The Workers' Compensation policy shall be endorsed via blanket-form <br /> endorsement to include a waiver of subrogation in favor of the State. The waiver of <br /> subrogation endorsement shall be provided. <br /> Coverage Term Coverage is required to be in force for the complete term of this Agreement. If insurance <br /> expires during the term of this Agreement, a new certificate must be received by the State <br /> at least ten (10) days prior to the expiration of this insurance. <br /> Policy In Effect Permittee must notify the State at least five (5) business days before the effective date of <br /> any cancellation, non-renewal, or material change that affects required insurance <br /> coverage. In the event Permittee fails to keep in effect at all times the specified <br /> insurance coverage, the State may, in addition to any other remedies it may have, <br /> terminate this Agreement upon the occurrence of such event, subject to the provisions of <br /> this Agreement. <br /> Deductible Permittee is responsible for any deductible or self-insured retention contained within their <br /> insurance program. <br /> Right Of Entry Permit& Monitoring Well Agreement January 12, 2021 (L-2620) Page 9 <br />
